Status is NOT required for you to file an INLAND application. You would want to ensure you fly under the radar as much as possible, because without status you can be at the mercy of CBSA wanting to send you back. Many folks are safe to fly below the radar and never have an issue, but a few are brought to the forefront for whatever reason and are at risk of being deported. I think if you feel like you will be able to stay under the radar and not get into any trouble, and you don't feel like anyone has it out for you, like a disgruntled ex, or mother in law or jealous sister (I think you get my point here) then you should just send that paper back in along with your file. You might have lost your implied status, but you may not have lost your place in the que.

This advise is what I am waiting. I understand I am at risk of being deported if somebody will tipped off CBSA about my illegal stay. We will send it back tomorrow hoping it will go through just fine until the case is closed. Thanks Allura71.

that sounds good then , but I won't live illegally if I were you though. I don't want to ever face deportation . If it work out fine if you keep a clean sheet I see why there are many illegal immigrants . Can't they find out that you are out of status some how?

I understand what do you mean. I went surfing information about CBSA, they won't serve you right away with deportation order, they will meet you first and go through the case. I will send my application back and just play it by ear.

Wouldn't it be the safest thing to go back to the Philippines and wait it out from there (not having any worries about being 'under the radar' in Canada)? The posted processing time of 14 months appears to be a kind of worse case scenario, many people seem to be getting their visas in 8 to 10 months these days.

As for the warnings on the CIC web site about incomplete applications, I get it. It's just unduly harsh in my opinion to not cut someone some slack for ONE missing element. I'm sick of the general lack of assistance from CIC (surly call agents, inability to reach foreign processing offices etc.). No problem to get in touch with CRA for paying our taxes, so why does our government want to put up so many road blocks to making our lives complete and happy with our loved one(s) in this process?! (I've written about it elsewhere, but the EU for example is clear about their citizens' right to the most efficient family reunification possible.)

I totally agree with you. CIC is a complete joke. When I lived in Japan, Japanese immigration was very efficient and helpful. However, I found that dealing with CIC an infuriating experience. Case in point, my wife still doesn't have her PR card.

Hi, Gumper! I don't have a problem going home and apply Outland. I can even apply now via Outland processing and go home if required. It is just that we don't want to get separated during the entire process plus it cost money to go home and back as we are living in one salary right now. My permit is closed hoping to get OWP sooner but my application is sent back.

The OP could also remain in Canada (and see how it goes) . . . BUT STILL apply 'outland'. You are permitted to apply outland from inside Canada. You cannot get implied status (which has been lost now anyway), BUT if ever you MUST leave Canada, your application would not be cancelled. If you're called for an interview then take a vacation to PH while you're at it, otherwise receive your COPR in Canada and "flagpole" at the nearest border for landing procedures.

Like Allura71 said, you don't need to have legal status to apply for spousal sponsorship. Besides, according to a case here (a woman facing deportation while her PR is in process) if you get stage 1 approval (AIP), then this has precedence over the deportation order. So even if CBSA manage to find you and do all the paper work for your deportation (which takes months cause first you have an interview with them, then you can file a PRRA - Pre Removal Risk Assesment, which will delay things) as long as you have AIP, they won't deport you. So if I were you, I would send those documents back to CIC asap.

And by the way, the woman I mentioned earlier, has been out of status in Canada for 8 years and she filed her sponsorship in January.

They did the same to me for the same form. It definitely sucks as some people just get asked to submit the one form. I guess we had the same officer. I don't know how they assess the inland application but maybe they'll put you to the front of the line? I don't know. I applied outland so it didn't really make much difference to my application.
