Have you ever worked illegally in Canada ? Yes I did.. But no I did not !

I know that the title of the topic is strange.. But yes.. Believe it :)

I will write a little short story of my problem

I came here in Canada as an exchange student for 1 year. Normally, any exchange student is not allowed to work off-campus, as mentioned on the CIC and they also put that as a *remark* on any exchange student's study permit.

However, my study permit had a remark *Peut accepter un emploi sur le campus ou hors du campus s'il répond aux critères d'admissibilité aux termes du R186f), v) ou w). * Which means that I can get a work on or off campus if these terms apply on me.

R186 v & w says :-
(v) if they are the holder of a study permit and

(i) they are a full-time student enrolled at a designated learning institution as defined in section 211.1,

(ii) the program in which they are enrolled is a post-secondary academic, vocational or professional training program, or a vocational training program at the secondary level offered in Quebec, in each case, of a duration of six months or more that leads to a degree, diploma or certificate, and * Not mentioned that the diploma has to be canadian ! which was the glitch and the key to escape ;) *

(iii) although they are permitted to engage in full-time work during a regularly scheduled break between academic sessions, they work no more than 20 hours per week during a regular academic session; or

(w) if they are or were the holder of a study permit who has completed their program of study and

(i) they met the requirements set out in paragraph (v), and

(ii) they applied for a work permit before the expiry of that study permit and a decision has not yet been made in respect of their application.
So I applied for the SIN and started working at Pharmaprix. After a month, when I was talking with the international student advisor in my university, he told me that exchange students can not work off campus and it is illegal etc. And when he saw my study permit he was surprised and couldn't advice me with anything.

So the next day I left the job and I stayed for a whole month depressed, waiting my DEPORTATION LETTER ! And I have made topics here and there and asked many people and they all said that I worked Illegally and that I will face consequences when I apply for the PR or study permit extension..

So I took a huge step and called CIC. I told them the story that I worked off campus and that I am exchange student, and I told them that I have a remark on my study permit saying that I can work off campus if the terms satisfy and that I will get a Diploma ::) She said yes but the Diploma should be from Canada I said it is not my problem that it is not clarified on the website .. So she left me on hold on the phone to check my study permit, and after 30min she came back and she told me : You will not be penalized because it appears that this remark was issued on your study permit by mistake from the officer. ;D But what you have to do now is to send your study permit to Ottawa to change it and get the right study permit.

So yes I sent my study permit in December to change the mistake and the application got accepted and I have received the new study permit with the remark that I can not work :p .

Now I am planning to continue my studies here and my study permit expires at 31/08/2016.

The question is, do I need to apply for a new study permit since the one I have now has a remark that I am not allowed to work? Or I need just to extend it before it expires and they will change the remark since I will become a regular international student?

And the most important question, when I am asked in the application if I have worked illegal in Canada, what should I say ? No or Yes ??

Do they have a background for my application and story and they would know everything that happened with the letter that I wrote when I applied to change the study permit explaining the issue ?

you did not work illegally as the mistake was from CIC's side and not yours and if you are asked in the application then you should write no. this would not create any problem in the future as you informed the CIC and the rest is history.
which college are you in and which course as I will be coming for fall 2016.

I am afraid to check no, and I get a refuse because maybe they won't check the history..

I am at Montreal University, Computer Science.

It is a really confusing question,

What I would do, If you have a copy of your old study permit attach it with your application and in separate latter, explain to them what happened to you

your application my take longer time to process but honestly you did not make any mistake !

They can see in your file that your old study permit was replaced and you should granted a visa with no problems

Thank you for your answer, yeah I have scanned it as well ;).

Maybe I can answer yes to the question if I have worked illegally, and I would write in the box ( See attached letter ) and I would attach the old study

permit and mention the story in a short way.

& probably they have the old study permit or a history of what happened.
