Hi there, Feb 10th 2017 we had are interview at Canadian embassy New Delhi. The interview officer at the end of interview said he was satisfied that are marriage is genuine in his findings, but there was one thing my wife had a DUI in America in 2005. The officer said it's ok he will send a criminal rehabilitation form, he also said you basically have a green light for a PR. Feb 28th 2017 we received the form, it said to fill and return within 15 days, we returned it by courier Mar 09th 2017. It is now Mar 29th 2017, I was wondering if my wil be traveling bck to Canada with me, I go back April 17 2017.

One night jail at police station, then judge said dinking driving classes and three years driving probation. All was completed.

If you are being sent the criminal rehab form - then it sounds like your wife will have to go through the criminal rehab process. I would plan on several more months before her PR is approved. It sounds to me like the visa officer is saying that everything is a green light and your wife will have the PR visa once rehab is approved. The good news there is that it looks like everything is good from a relationship assessment perspective. The bad news is that the rehab process can take a while to complete. At least that's how I read the VO's comments. I would not be expecting that your wife will be able to travel back to Canada with you unfortunately.

If there was three years driving probation then there was a conviction. Sounds to me like the applicant is inadmissible and has to go through the rehab process (which makes sense if the conviction was in 2008 and probation would have ended in 2011). So it sounds like all that's left to process is the rehab application. Again, bad news on that is that processing times can be quite long.
 
The prohibition ended 2008 and in 2018 it will be 10years anyways. The officer said you can wait in till then or I think your excited to go soon, I can send the form in two weeks. Then the letter said return within two weeks (why).

CIC always sets a deadline for returning documents. That part is very normal.

We've seen wildly different processing times for rehab applications so it's very hard to guess what will happen in your case. A few only take weeks (this seems to be rare). Most seem to take months. Some take over a year. Hopefully you're going to fall into the weeks bucket. Good luck.
 
The letter also noted that her medical was expiring in April 2017.
I am in the same boat bhaji. I applied my criminal rehabilitation on May 12th 2017. I applied in Los Angeles, USA consulate since i am in USA. I am also not sure if they will accept my application or return it and asks me to sent it to India since i am not American citizen. There is no clear instruction on it either. It doesn't say anything how long it will take? Did you receive any receipt notice after filing criminal rehabilitation? Do share your email please. My Update: My application was received on May 18th 2017. I am still waiting to hear something but no luck yet. Keeping my finger crossed. Please let me know if you hear anything on your case. I am wondering Canadian consulate in India might be faster.
 
Isnt it best to apply for the criminal rehabilitation and spousal sponsorship together ? How long will that take a year?

What I have read. It's best to submit both applications at the same time. The fee for the criminal rehabalition is 200.00 in which you pay through my fees on CIC website. I know of someone who was denied a PR based on being criminally inadmissible.
