@ Nomad_Musafir : the person handling my case at the the Law firm?? If so, there are total 3 individuals whom I've had correspondence with. :( sad but true all the three said that they are updating my file at some point...& none of them realized anything wrong.

I will wait till Monday to hear any correspondence from them and then will call AINP directly..

MY CONCERN IS THE VERY FIRST POINT.. I was working under OPT (F1 visa) untill October 2008 and then started working on H1B visa.

I am sorry for whatever happened to you. Clearly you were not eligible for AINP at the time of application because you have not worked 1 year on H1 before your application date. But you know whatever happened is happened. Lets see the ways left for you to move forward.

1) Call AINP and speak to them and explain them the attorney messed up. Given you have spent lots money, time and effort, they should show some lenience.
2) Talk to your attorney and request him to get his mistake corrected.

If either of above 2 ends up fruitful thats good for you. Wish you all the best for you and keep posted.

If you find attorney not helpful in resolving the issue don't hesitate to file a complain about him with appropriate authority.

Don't wait until Monday. Call AINP now and ask them about the workaround.

No I meant AINP officer. The lawyer and co. are evidently useless.
 
Hi Folks,

After an extremely long wait of 1 year 1 month, I finally received my rejection letter today at my residence (out of US). The letter stated that I have been rejected as I am not maintaining my H1 status currently. It says that I have to maintain my H1 status at both the time of application and at the time of final decision, tho I applied on 16 Jan 2009.

Good luck and goodbye to everybody. Thanks a lot to all those who helped me during my initial stage of application!

PS: Letter was dated Jan 22, 2010, postmarked 3 Feb, if it helps anybody.

So they just arbitrarily change the rules when they want to.
