I think we should not loosse hopes.I think wud still consider applications for nomination who submitted their applications before 19th feb and currently out of h1 status.
However, one more question, How do we request US pcc from FBI while in India? Can they send th eforms in India and how to do the fingerprinting in India?any thoughts?

I guess we should not loose hope.Luckily I did not go through lawyer and saved money there. As far as fingerprinting is concerned I got it done while I was in the US. So now I will just apply from India.

Redstar did your applicaton reach before Feb 19th if so what did David Cohen say. I heard he is a very good lawyer

My first application was sent on dec19th for pre-assessment i received my invitation received on 11th Feb and my application sent on mar17th and file number received on may 25th and other documents asked on 24th Nov but by the time iam out of H1,so i don't know whats happening with my application how they are going to consider.

It clearly states that any application that reached before Feb 19th the applicant needed to be in status only at time of application. In your case You received your invitation to apply on Feb 11th but unfortunately your application was sent in March so i am not sure how AINP would treat your case.

What is Mr David Cohen saying

Is it Ok if you were in status at time you received invitation OR you had to be in status at time of application????

Hi Guys, I don't mean to sound pessimistic but this is a grey area. In fact I was under the impression that I fall under the old process since as mentioned in one of my posts before, my file was submitted to AINP in Nov 2008, recvd the invitation in Feb 2009 and application was recvd by AINP on March 2009. When I called up Mr. Cohen's office, the paralegal mentioned that this is a grey area and she will not be able to give me a concrete convincing reply since AINP is not clear on the same. I was lucky to get my H1 renewal approved so I did not pursue the matter any further but from her reply it totally depends on AINP.

I guess it is a grey area only if appliction reached after Feb 19th. But if application reached before Feb 19th it should be pretty simple
