Submitting an H&C application does not stay a removal (meaning you can still be removed from Canada). Once you have received a positive stage 1 decision in your H&C application, CBSA won't remove you. How long ago did you apply? Do you have first stage approval?

First stage approval typically takes over a year. Unfortunately you still have a while to wait.

Hardship unfortunately doesn’t necessarily mean you can remain in Canada.

There is a chance at approval but it is dependent on many elements. If anyone having a child in Canada could stay if they applied for H&C it would encourage people to have children in Canada and that is not want Canada wants to encourage. It will be dependent on many things. Where you come from, what were the circumstances or your arrival, whether your child is healthy, etc. Nobody can predict what will happen to your case especially with such little information.

Hardship matters so read 5.11. Factors to consider in assessment of hardship

It may be that you are eligible for PRRA yet and following those rules may gain you a Stay of removal at some point, but that's something for you to consult with a lawyer or community law group about, if you have one handy.

It is most important to keep your application up to date with any information that you come across that could be a positive thing for the officer to consider. Keep your own file if that helps.

Try and relax and learn from the manuals because they are online and they are the guides for decision-makers.

Think it is a good idea to read the manual. Hardship definition for H&C and what you may consider hardship are very different. If there is poverty in your home country that doesn’t mean you will be awarded H&C. You should be reviewing this with your lawyer and asking for advice from your lawyer about the strength of your case based on similar cases from your country of origin.
