Hi everyone,

Has anyone applied for H&C application for parents and got approved?

My father in law temporary resident visa and Super visa got refused 4 times and this time we are thinking to submit H & C for him on the following grounds.

My husband is the only son of my father in law and his age is 81 years old. We were inviting him for my delivery of our first child and it got refused.

Any suggestions please....

H&C is only possible if your father in law is physically in Canada. Is he in Canada?

EDIT: Just to add to the above, if your husband is an only CHILD this is a good argument for H&C. The fact you want him to be here for the delivery of your child would not be an argument for an H&C application. But again, the most important requirement your father in law needs to meet is that he must already be physically in Canada to qualify to apply for PR under H&C. If he is outside of Canada, then an H&C application is not possible. In that case your husband will need to wait until he qualifies and is selected as a sponsor through the regular PGP program.
