My family has been denied visa by Canada, I didn't resort to fraud to get them here. I don't think you understand why and how a country gets to extreme policies. It's culmination of decades of abuse.

Cracking down on immigration fraud has nothing to do with what Trump is actually doing. The US already has very effective ways to deport people but they may take time and don’t involve highly produced videos that you can show your supporters that depict cruelty and ignoring the constitution as being “tough on crime”. The Canadian government will not be publishing shackles & chains ASMR videos anytime soon which is a good thing.

Hello, I am a new member here.
For H&C, Am I allowed to keep my current status until the H&C decision is made or I have to stop working when my work permit is expired? My work permit is expiring in August.
I planned to try H&C, as I haven’t found other options. My family came here under closed-work permit, we have been here for nearly 5 years. I have a daughter who came here when she was 1 year old. We have been working and paying taxes for over 5 years. My spouse also has a stable job here and his employer is very willing to support us. However, it is so hard to get LMIA, and we are over 30 already. Please help us, if anyone knows a good lawyer who is experienced, let us know.

thank you

You would need to stop working once your work permit expires.

Weak case. Work hard and paying taxes is not enough for h&c.

As others have pointed out the chances of H&C approval is going to be very low if that is the basis of your case. You need to be exploring other options. LMIA points no longer count. What are your profiles: NOC, years of work in Canada and abroad, age, language score EN/FR, what province and do you live in a rural community, etc.?

If you are residing in smaller provinces in canada and working nearly 5years on valid work permit,it is hard to believe that you haven't gotten PR by now not even through PNP before 2023 canada has less temporary residents, now they are reining on temporary residents..

The idea is to provide deterrent, look how fast the crossings dropped. Imagine the poster here who thinks of H&C as just another "stream" is shackled up with their entire family and loaded on a military plane to be sent home. It sends a strong and clear message - don't take advantage of good people. Just because your WP expired and you have a baby, it doesn't mean you are eligible for H&C. People can disagree but imo, the abuse is rampant and nothing can or will be done to stop it.

I agree with other members that chances are low, but not impossible. I have seen similar cases approved under best interest of child and establishment. I would say that your file has stronger merits than all parent/grandparents cases that are currently flooding H and C progam.

We have been residing in Britsh Columbia.

Have you looked into the PNP programs for that province?

One of the big downsides of H&C in your case is that you'll almost certainly have a long period of time where you will be living in Canada without the ability to work. Do you have enough funds saved to live in Canada for 1-2 years without working? That is something to consider.

The case is based on establishment in Canada, best interest of the children, adverse country conditions.
I just want to know if I am allowed to keep my current status until the decision is made, or I have to stop working the moment my work permit is expired.

I know that we can apply for work permit after the initial stage, but don’t know about the work permit. My friend shares similar case to mine, and her lawyer asked her to submit for a work permit after him sending submission letter.

Answered previously. You have to stop working once your current work permit expires. You will qualify to apply for an OWP once you have AIP. The downside of that is that AIP is typically not received until well over a year into the process.
