I was wondering if anyone knows if you can apply for a study permit while awaiting h&c application. The h&c application was just recently submitted and I know it takes about 30 months for completion according to the processing times. If a study permit expires and its after the 90 days have passed but an h&c application has been submitted, is it possible to apply for a study permit as well or is there any way to study while waiting for the application to go through?

As well, is it true you can apply for a work permit once you have been accepted through the first stage? I thought perhaps a study permit worked the same. Any advice would be much appreciated!
 
The Government says: "Study permits may be issued pursuant to R215(g). Applicants may request a study permit by completing an Application to Change Conditions, Extend My Stay or Remain in Canada as a Student (IMM 5552)". So the answer is yes; you can be a student while waiting for H&C. to be considered. After you get the student visa you must take a Government recognized two years (minimum) course to be eligible for a work permit. While you are at school you CAN ONLY WORK 20hrs. A WEEK. THIS WORK MUST BE ON CAMPUS.
 
The bigger issue is whether your are able to get one. It is hard to prove that you will not stay in Canada when you have an H&C in process. You will also have to show you can pay international fees.

Agreed with canuck78. You can certainly apply, but that doesn’t guarantee you will receive either a SV or a WP. It’s all at their discretion.

Hi, I read your question as asking whether or not the submission of an inland H&C application provides any opportunity for you to receive a Student Permit by applying for it inland, while you are currently in Canada without status - you had a study permit but it expired more than 90 days ago. I think others have commented upon your ability to apply for the permit outland.

If I am correct about the question and your situation then the answer is no, not before receiving the first stage approval. Your situation is that you are in Canada without authorization and could be subject to enforcement action and the application just submitted doesn't lawfully stop any of that from happening.

You can certainly try applying for the study permit if your status in Canada is still valid. The chances of it being approved are likely quite low since it requires you to demonstrate that you have strong ties to your home country and have no plans to remain in Canada long term. The H&C application demonstrates the opposite. Note that the application cannot be sent to a visa office within Canada. It has to be processed through a visa office outside of Canada.
