Hi all, I have a question about G5 sponsorship, my brother and his family are living in France as a refugee, but I want to sponsor them here in Canada. Now, are they eligible to get sponsored since they already got their refugee status in France? I asked one of the immigration lawyers and she said no, they are not eligible but I want to know from you guys. Thank you

They are not eligible to be sponsored. They have already been resettled by France.

See the below requirements from the program guide for those being sponsored:
  • and does not have a prospect of another durable solution, within a reasonable period of time, that is:
    • cannot return to their country of nationality or habitual residence
    • cannot integrate in the country of refuge or the country of first asylum; and
    • does not have another offer of resettlement from a country other than Canada.

They need to immigrate through programs like Express Entry or PNP programs based on their education, age, work experience, language and funds.

Hello, I have friend that was being sponsored through group 5 sponsorship outside Canada. Unfortunately he was given refusal letter after he did an interview with case processing officer because the officer said the refugee wasn't truthful about his case so I would like to know if he can apply an appeal about his case .

There is no formal appeal process. You would need to initiate a judicial review with the federal court of Canada.

So will he send the decision letter of refusal he received from the visa processing office?..are the cases where that decision was overturned. Thank you for the help

Are you asking about contacting case management or the JD?

If he wants to request the case management office look at his application, he needs to send more than the refusal letter. In addition to the refusal letter, he would want to indicate why he is requesting that the case management office review his application again. He would also want to address the reasons why he was refused.

I'm not aware of any cases where the decisions have been overturned by the case management office but I'm sure they exist. Maybe others know.

If you are asking about the JD, the next step is to hire a lawyer.

Again, there is no appeal process so I assume you are asking about judicial review.

I think it's 15 days from the time of refusal but I'm not 100% sure.
