Granted a work permit, but not a TRP or ARC...?

Hi, All— I’m an American who’s been living in Canada for 8 years. I was recently issued an exclusion order (due to overstay of my visa, because of a complicated and unfortunate mix of factors, none of which were deliberate evasion of immigration laws and authorities, and which I was working to fix even before the exclusion order came in) and have been told I must leave the country on July 31, 2018, and cannot return to Canada for 1 year. This will mean the loss of a job offer I have, remove me from all my friends and support network, and break my partner of three years and I apart. On my lawer’s advice, I applied simultaneously for a work permit and TRP.

I received the work permit. The TRP, though, was “not considered”; neither approved nor rejected. I also did not receive an ARC, even though the Canadian government website says ARCs are dealt with in the context of work permit applications and I should not apply for one separately.

With a granted work permit I can only activate if I leave Canada and re-enter, but also an exclusion order that disallows me from re-entering, and no TRP or ARC (or even ability to apply for one, it seems), I feel I’m in a beaurocratic catch-22.

Advice and/or feedback would be greatly appreciated.

I believe that you will need to leave Canada, as ordered, (or you may be deported), and apply for an actual visa in order to get the ARC process started. Leaving Canada appears to be non-optional.

I believe that you will need to leave Canada, as ordered, (or you may be deported), and apply for an actual visa in order to get the ARC process started. Leaving Canada appears to be non-optional.

Given what the gov’t says about work permits and ARCs going hand-in-hand, I’m unsure of why I have the work permit, but no ARC. Or even why my application for the work permit was approved, but the simultaneous application for a TRP was simply ignored.

Are you suggesting a difference between a work permit and a work visa? I have the former. But, the Canadian government website doesn’t make a distinction either way in regard to not applying for an ARC at the same time.

I believe that they are different from each other. However, I'm open to being corrected about that. There may be some linkage between the two, especially when dealing with visa-exempt nationals, where a WP may be linked to an automatic eTA.

hi, i am also from usa and been ordered an exclusion order from canada. I have my work permit with me . so in ARC do i need to apply for TRV aswell or not? i am so confused. my husband is a canadian citizen.
