Question regarding my brother's current situation in Canada.
He had been studying at a private college in Vancouver, BC since March 2018. He had graduated in December 2018 from the same college. Right now, his visa expires in March 2019. Similarly, his spouse, has an open work permit (with same expiration date as his). They have both have continued to work on the basis that the visa expires in March 2019
At the same time, his spouse, had been accepted at Langara College where she would study a diploma beginning May 2019. The idea is that she would get a study permit, whereas he would apply for an open work permit (they have not yet applied though) with the hopes of finding a path to Canadian permanent residency.
1) what are the chances she would get a study permit with a low english test result? His spouse didn't actually take the IELTS academics or anything because Langara College has its "own" english test format and they use that as a benchmark to admit non-canadians residents into the college. Therefore, she made it just slightly above the passing score to enter Langara College as international student.
2) Are they actually working illegally right now? This is what i believe, and please correct me if I am wrong. His visa expires in March 2019 but he no longer meets the conditions of it a study permit. i.e. enrolled full-time or apply for PGWP. I know a PGWP is not possibility since he studied in a private college. I advised them they both should've stopped working right away when he graduated in December 2018 but my advise was taken badly.
I am primarily concern about these two facts above because it may affects their ability to reaching PR status in Canada.
