hey guys,
i had applied under noc0213,after receiving 2nd aor, i got rejected due to the insufficient points for language.
i had nt given my ielts score yet,cause i waz late for my ielts exam.
can i reapply again or wait for the new NOC list???wht to do
plzzz HELP
wht is the immigration and refugee protection act??can anyone explain??

It is usually better to take the IELTS before applying. That way, you know if you have enough points before you apply. However, since there are some hints that the NOC list may be changing, it would be better to apply now while you still qualify but take IELTS as soon as possible.

For anybody else in the same situation, the 120 day limit should be taken seriously. If you do not have all your documents ready by that time, send what you have and include a letter explaining what you do not have and why and that you will be sending it along as soon as you have it. This will not guarantee that your file will be kept open forever while you wait for the last documents but it is a lot better than to send nothing or to send incomplete documents without an explanation.

if i apply now,but after 120days when i submitt docs to CHC,my appl is rejected stating my code is nt in noc list now(since in aug-sept) noc list may change,then wht?since the same thing happened to candidates who applied btw feb 2008 and nov 2008.nobody knws wht happened to their applications??
plzz suggest??

I am fully agree with LEON but you got reason too, so what option you have in above situation, Send application ASAP, before (May/May not) change, Sydney will take aprox 2-3 months, so assume its 2+4(120), in total you have 6 months. Start preparing IELTS at your best, just keep remember that it would be final play. If you unable to score in IELTS again, then there would be no way but withdraw your application. You have 6 months, you can even try twice or more for IELTS.

I would pay heed to Leon's advice. Yes, it is possible that the new list [if ever/whenever it comes] is implemented in 'retrospect'. But, wouldn't it be better to reapply [& get an earlier timeline] than to wait for posterity?

Nobody knows when or if the NOC list will change, which NOC's would change or if it will be done retroactively like they did in Nov 2008.

There is one set of circumstances where you would gain from applying again right now and that is if they were to change the NOC list soon and cut your NOC out and make the date effective as of right then. If that happened and you hadn't applied yet because you are waiting for IELTS, you would not qualify any more.

The only thing you could lose by applying now is if you don't manage to get a good IELTS in the next 6 months. It's up to you. It is possible that they don't change the NOC list, that they don't change it soon, that they leave your NOC on it, who knows.

Apply now and also mean while appear for IELTS. If you apply now then record is created at CIO and your application is locked and is subject to current rules and regulations also at the time of processing if you application is selected eligible for processing. So apply soon.
