Hi ,one of my friend got refusal letter from london high commission.In this letter they mentioned,they were not satisfied with job description as a college teacher or vocational teacher while he is teaching in college and it is quite ridiculous to get refusal letter .He applied after feb 2008 ministerial instructions.Can anyone kindly tell me what do next and what is the process of appeal as well and what is his chances,kindly reply to my query as soon as possible.Thanks alot

Hi ,my friend sent his complete application in feb 2011 ,and his NOC IS 4131 .Can you tell me how to appeal and what to do next .Thanks.

Not enough jobs for them now in Canada.
One of the most unwanted NOC's now.
To me he can request a review but as they were not satisfied with Jobs and Duties which is the part where he cannot make any changes now which would finally resulted in a no hope situation again for your friend.

There is simply no fixed criteria about Jobs and Duties comparing which one can satisfy CIC.

This seems like turned out to be a lottery these days.

refusal is nothing to do with ur job duties or experience or anything.

the major thing is that they dont need people from this noc any more.

plz dont mind my words, they will not consider any damn thing, believe me, they have to get rid of 4131.

buddy, i forgot to mention that the refusal is based on JD. alrite?

I must tell u, that while going for Judicial review its very important to understand the grounds
on which the case will be fought.


Judges give high deference to the decisions rendered by the VO, so only rare cases got thru.

Its strange/weird I must say, VO's reject the applicants based on job duties/experience.
I think it should not matter because once u enter Canada they want new landed immigrants with Canadian experience so what's the point if the job duties match or not.....

Dear pakistannumber1 - > there may issue with the cross verification / doubt on job duties etc. VO not satisfied with the evidences provided by ur friend . it may happen to MI3 application also .
 
Few days ago I have received letter from Sydney Australia Visa Office that they have rejected my federal skilled worker PR application which I filed in June 2010 under NOC 1111-Accountant. This is what their explanation for the refusal:

Age 10
Education 20
Experience 0
Arranged employment 0
Official language proficiency 14
Adaptability 5

Total 49

The only support document for your claimed experience as an accountant between June 2005 and January 2009 is a letter dated May 15, 2010 by a store manager in Karachi, Pakistan stating you were an accountant since June 2005 and lists the duties performed. I am not satisfied that only a letter is sufficient to support the claimed experience. It is
not unlikely that a person off the High School would begin as an accountant immediately after getting the high school certificate without any training in accountancy. It is the onus of an applicant to provide enough evidence to support the alleged experience, such as pay stubs, pay direct deposits, work contract, tax declarations, etc.

The only thing on the basis of which he rejected is that I didn't submitted enough evidence to support work experience. What I submitted to them is only my experience letter from my store but unfortunately my store manager didn't mentioned in the letter that I took 6 months on-job training. Nevertheless as mentioned in the letter that "it is NO UNLIKELY" means it is normal for a person off to high school would begin as an accountant, although I know they have done typing mistake but as this mistake is in my favour so do you think this sentence can create any harm if I'll appeal? Other thing is I didnt submitted them any other evidence as my consultant didn't told me to do so but I can arrange all of these evidences now including tax return.

Now my questions are:

1. Is there any option for me to appeal on this decision? If yes how much time I HAVE? what will be the procedure and what documents should I submit this time to be 100% sure?
2. Do I need to care about this sentence "It is not unlikely that a person off the High School would begin as an accountant immediately after getting the high school certificate without any training in accountancy"

Please reply urgently as I got this refusal on 15 march 2012 and its already 11 april 2012

I know it was my responsibility to submit complete documents but can't I ask reconsideration because it was only document submission issue rather than any fake document or job responsibilities not matching kind of issue? Urgent reply guys please
 
This is not just a document submission issue. You failed to submit the required documents at the time of decision making. Your agent is rubbish and has got no idea how things work. Nothing will be done even if you submit new information.

In case you were a visa officer, would you believe if someone pops up with letter from xyz saying that abc is an accountant ?. You have blown up your case yourself.
