Hello Everyone,

One of my friend she got her PR thru Express Entry and she did her landing process this week And now she wants go back to India and get married and stay there until her husband gets the PR. Can she do that?
We asked few consultants here in Canada some are saying that is okay she just needs to keep $15000 in her account in Canada. Some are saying she can’t do this at all.

Please advice is it okay to stay in India while her husband’s application is in process?

the sponsor if is a PR then he/she needs to be in canada during the whole sponsorship process.. some says that short trips are ok but CIC require to be in canada .. :)

The consultants that said it was ok should be reported!

As Tajnuba indicated, only a Canadian citizen can sponsor while being outside of Canada.

She can't stay in india.
 
Doesn't make sense at all.. A pr can travel but not stay out of the country passed the 6 months mark . Staying out of the country pass 6 months disqualifies the sponsor as a pr.

No, this is wrong. There is no such regulation stating 6 months.

The rules simply state a PR must be residing in Canada during the sponsorship process, there is no amount of time given. So how long a PR can stay outside is totally at discretion of visa officer reviewing the file. If they feel 3 months outside Canada means the PR is no longer residing here, they could cancel the app based on that.

According to the call center if a pr stays out of the country for 6 months or more you could lose your pr status therefore won't be qualified to sponsor as a pr. Pr can leave the country but not for long periods of time .

Completely wrong. Call centre is well known for giving out very bad information, such as this.

PR will not be in violation of residency obligation and face losing PR status, until they are outside Canada 3 years out of any 5.

And for sponsoring a family member, as previously mentioned the time PR is allowed outside Canada while app is processing is at discretion of the visa officer processing file, there is no specific amount of time stated in any IRCC regulations or operating manuals. Most recommend not to push more than a month or so.

As said above, this is completely wrong. Rob is correct.
