Got LMO can i got to the border and apply for Workpermit

Merry Christmas to all,

I have received a positive LMO for 2 years.I am already in Ontario and have been working with this employer for the past one year on an PG Open work permit.My lawyer says that instead of applying online which may take upto 86 days i can go to the border myself at Niagra and get the new work permit issued.He says its a simple process.My Questions are:

1.Is my Lawyer right ?
2.Will it affect when i apply for the residency that i didn't apply for the work permit in the normal channel?
3.Is there any risk (like denying the work permit) if i go in person and apply at the border?

Please advise me.

This process is only available to those from visa-exempt countries.

No.

3.Is there any risk (like denying the work permit) if i go in person and apply at the border?
Same as if you send it in by mail.

Thanks a LOT.....Am from India and i think Indians are not visa exempt....

I did it as an Irish citizen a few weeks ago and all was well - everyone on the US and Canadian side were more than helpful. Then again it was a weekday in Winter.

Just bring ALL the relevant paperwork with you and if you have doubts about the paperwork, bring it anyway. Good luck.

yes please. It is really important. If they are unable to answer, also try to reach the CBSA itself if possible.

Eligibility to Apply as You Enter Canada:

You can request authorization to work in Canada as you enter Canada but only if you meet the following requirements:

• you are temporary resident visa exempt;
• you already hold a valid medical certificate, if it is required for your job; and
• your job does not need a labour market opinion (LMO) from Human Resources and Skills Development Canada (HRSDC) (some exceptions apply); or
• you hold an LMO from HRSDC.

you're right, only applicants from visa exempt countries could. i have a friend who is not from a visa exempt country who went to the border with her employer to get a work permit, they gave her her work permit but the officer told them you're not supposed to do it if you're not from a visa exempt country. so according to the rules you cant, she just got lucky.

CBSA does not make the rules for CIC, and as mentioned in the link, you need to go to the CIC website for information eligibility to obtain a work permit at the POE.

Some workers can apply at a port of entry

Most foreign workers must apply for a work permit outside of Canada. However, you may apply for a permit when you arrive at a port of entry in Canada if:

- you are from the U.S., Greenland or St. Pierre and Miquelon;
- you do not need a temporary resident visa (TRV) to visit Canada and your job does not need a labour market opinion from HRSDC;
- you will not be working as a live-in caregiver or as a seasonal agricultural worker;
- you do not need a TRV to visit Canada, your job requires you to have an HRSDC labour market opinion and it has been issued by the time you arrive.

To apply this way, the labour market opinion confirmation letter for your job offer must be available, and you must produce the offer of employment and other necessary papers when you arrive. Remember that you must find out what papers you will need before arriving in Canada. Check with a Canadian embassy, high commission or consulate.

Ireland is a visa-exempt country, India is not.

Dear Friends,

As i promised i talked to CIC today.

This is what they said;

If you are from a country which is visa exempt...yes then you can do it at the border.
Otherwise you can try but the officer may tell you to apply online or do a mail in to some office(sorry didnt get the name of the place).The chances are less to get one stamped for me.
So the officer said we have the risk of getting stuck if i got the border as i am from India which is not a visa exempt country.
