Got ignored by Express Entry twice

Hello,

I have lived in Canada for over 8 years now, came as an exchange student, graduated college, and have been working in the same field as my diploma for 4 years now. When it came to applying for my permanent residency I admit I was rather late and only applied close to the end of my PWGP.

With one year left on it, I hired a company to do the leg work for me. We proceed to apply for the federal process and twice for the Express Entry in the last 18 months. According to the company I hired, neither of those times the application got denied but rather "ignored" since I literally haven't heard back. They said I didn't even get a process number (12 months in) for the federal yet. When I first applied, I had a score of 404, so to increase my chances I applied for PNP and got approved along with a work permit(7 months ago). Even after all that the company keeps saying I still have 13 months left on my federal process(i don't even know where they got this process time from).

I am heartbroken in seen so many draws for lower scores and I don't even get a replay back. I feel like I made a big mistake hiring them and I don't know what else to do. I don't know if they are hiding things from me or if they are so incompetent that they messed up my application to a point of no return.

Should I try applying again? or should I hire a lawyer?

There's no such thing as "ignored". They are lying to you.

Either you have enough points and are selected or you don't. Either your profile is properly set up or it isn't and you won't be selected. If you are sure you should have been selected, then your company has screwed things up.

Find a new company or do it yourself. Again, they are lying to you.

I have to also add that it's not at all clear what has happened based on what you are saying.

You can't apply directly to FSW / Express Entry. You create a profile, enter the pool and wait to be selected (receive ITA). You don't submit your application until you have received ITA. Profiles are valid for a year.

It sounds to me like your profile wasn't selected out of the pool. This doesn't mean it was "ignored". This means you didn't have enough points to meet the cut off for any of the draws and be selected / receive ITA. If you are sure you have enough points to be selected, then the problem is the people you have hired. They have screwed up your profile somehow or maybe not even submitted it. Fire them and either hire an immigration lawyer or do it yourself.

Sorry, that is correct I have never received an ITA. Is there any way I can contact the government of Canada to get more information on it? I tried applying for the Access to Information Act and the Privacy Act, would that tell me anything?

There's no application - so no, to the best of my knowledge there is no way to do that. You're just in the pool.

IMO I would take matters into my own hands and either hire a very capable lawyer or dedicate the time to researching the process yourself so that you can get a proper profile entered into the pool.

I assume you have IELTS or CELPIP results that were received within the last two years? I assume you have at least one year of full time work experience within the last three years in a NOC A, B or 0 role and that is not self employment?

i have a PNP letter from Alberta.

from my own experience, get the hell rid of the 'company'. I had similar problems with an immigration law firm. Once I broke ties with them, I suddenly got PNP and ITA

yes, sorry that is what I meant, I am in the pool. Yes, I got my IELTS and I have been employed full time for 4 years now(NOC B).

Sure - you can do that. Canada isn't a very litigious country so you might just end up getting your fees back that you paid them.

Make it a priority to get a proper profile in the EE pool for yourself asap. I would start with that and then worry about them.

On what basis did you obtain your current work permit? Was it through an LMIA? Something else?

You're fine. No impact to your work permit.

You just need to get the EE profile sorted.

I don't know how to withdraw an EE profile someone else has submitted (if that's even possible). I'm sure someone else will comment on that.
