I have applied a visitor visa before my work permit expired. I just get my file number a few days ago when I am implied status. Now I am still implied status. Can I apply a BOWP? If I can, can I work in a different company? If I can work in a different company, do I need to let CEC PROCESSING OFFICER know? If not, can I work in different province?
For example, I used to study in A province. Then I work in B province because easier to get a high position job in order to apply CEC. Now I got file number, and I want to go back to A province to work because I have friends and relatives there.
I heard some people said there is QUOTA, is it true?

Your advice is very important to me. I very appreciate your kindly help!

Sincerely!

Thank you!

Sorry but you cannot apply for a BOWP.

You need a valid work permit expiring in 4 months to apply for BOWP.

You have already applied for a visitor permit before the expiry of your work permit so there is no need to apply for restoration.

You would need a LMIA and a job contract to apply for a new work permit. Are you from a visa exempt country?

Folks,

here is my situation and I got my open work permit for a year (till August 2015).

work permit with current employer was still August 2015.
because my project was cancelled, I had to move back but I went on to apply for my open work permit.

I applied on 25th July 2014 and I received my work permit on 13th August 2014.

I hope this helps.

PS: I have used gic site to find out if I am eligible or no. Based on the questionnaires, it said I am eligible and so I applied.

Best Regards,

But I haven't received my visitor visa. Therefore, I want to ignore the visitor visa then to do the restoration. I am from China.

Well, I don't think CIC will just ignore the visitor visa after they already received your application... Maybe you can withdraw your visitor visa application then apply for restoration? I don't know how restoration works though, as I never applied for it.

I have applied for visitor visa doesn't mean I have already got the visitor visa. That is why I am implied status. The point is many new polices issued and many people don't have past experienced to resolve it.

- you are no longer eligible for a BOWP.
- There is no need to "restore" if you have submitted an application for a visitors permit. You should not try to cancel your application for a visitors permit, because then you will be out of status. The visitors permit allows you to remain in Canada and look for work.
- Before you can work again, you will need a temporary work permit. To get this you need to first find an employer who is willing to obtain an LMIA for you, then apply to change status from Visitor to Worker.
- For CEC applicants, it does not matter what province you are in (or even if you are in Canada). If you want to move back to Province A to look for work, no problem. Just keep CIC updated with your change of address.

Thank you for your opinion. The point is I applied a visitor visa, but don't know if I am passed or rejected. In case I get rejection, I want to applied a "restore".

BTW, do you mean I can leave Canada when I get my file number?

- You can apply to restore your status as a worker (or as a visitor, or as a student), but you have to be ELIGIBLE for a work permit to restore your status as a worker. You are not currently eligible, so there's nothing to restore.

- If your application for visitor permit is refused, and you obtain an LMIA and want to apply for a work permit, THEN you need to apply for restoration along with your work permit. It's part of the same application form. See here -
http://www.cic.gc.ca/english/information/applications/guides/5553ETOC.asp

- If your application for a visitors permit is approved and you obtain an LMIA and want to apply for a work permit, you don't need to restore because you already have valid status. You would apply to change conditions from visitor to worker.

Yes. If you applied for PR under the CEC class, there is no requirement to remain in Canada while waiting for your application to be processed. You can even apply from outside of Canada.

You don't even have to wait for your file number / AOR, as long as you provided a stable email address and you make arrangements for someone to look after your mail (just in case).

Thank you kindly! I do not have to leave Canada right away. Just want to know a few options. I shared your information with friends since you said can leave Canada with File number. Some of them said I can't. Still confused. If you could provide some details about a cec file number holder leave out or stay in Canada, links with CIC website. That will be great. Thank you again!

You can't leave Canada if you are on implied status and want to keep it -
You can't leave Canada if you have applied or plan to apply for the Bridging open work permit

but if have applied for CEC, then leaving canada will not affect your application, you can even apply from outside Canada.
