Hi All,

Have a small question regarding working aboard after 1 year of working in Canada.

Saw some posts regarding foreign work experience will not be counted into CEC. But all of them are within 1 year.

My case is that I worked and resided for a full 13 months in Canada with a Canadian employer. But I left Canada and went back to my hometown coz of a family emergency for 2 months.

I was still working remotely for those two months (got paystubs). I returned to Canada after two months. Now I am still working for the same company in the same role.

I got 2 years of work experience if the two months working remotely outside of Canada count. If they are not counted, I will not have 2 years of work experience, then my score will be lower than the minimum score for this draw, which I believe my application may be rejected...

Could anyone please kindly share their insight/experience on whether I should accept the ITA or decline in this case? The CRS score has been very high and I really hope I can get my PR soon so I don't want to miss this chance. But don't want to get rejected too...

Thank you !!!

You can count the two months as foreign work experience (just not as Canadian work experience).

What happens to your score if you count the two months as foreign work experience? Does your score drop below the cut off or stay above?

Hi, Thank you for your reply. I cannot change my score now as I got the ITA already, so I am not sure if it will go down or...

Hi, I just tested, if put the location of those two months job outside of Canada, I will only get score for one year experience..and will be below the minimum score :(

The right thing to do is to decline ITA and correct your EE profile to show those two months as foreign work experience.

You can of course chose to accept ITA. However in that case it's unknown if your application will ultimately be approved or not since you technically cannot count those two months as Canadian work experience.

For sure you can't count it for your Canadian experience. I think you will need to decline the ITA at this point, which is very unfortunate

You should speak to an immigration consultant who answers a single question for a low fee and see what they suggest. You don't want to lose out on an ITA and not be sure

The employer is Canadian, you work with a Canadian work permit. You got paystubs. I am sure you can count it as Canadian experience. You can work remotely from anywhere.

This is wrong.

@scylla @Copingwithlife Could you please give some references to prove it wrong?

Well one would be the IRCC website itself and the definition of Canadian work experience.

https://www.canada.ca/en/immigratio...bility/canadian-experience-class.html#minimum
  • have gained your work experience by working in Canada while under temporary resident status with authorization to work
The other would be refusals we've seen here where IRCC has consistently applied this rule.

This rule is very well known on this forum. Remote work outside of Canada is classified as foreign work even if you are working for a Canadian employer. You need to be physically working in Canada to count it as Canadian work experience.

Anyway I don’t see any reasons. If I travel outsude of Canada while working, so I should exclude these travel spans from Canadian experience ? I don’t think so.

Yes, you need to list these periods of work separately. So let's say you spend two months working outside of Canada, you would split your in-Canada work experience and your outside of Canada work experience in your EE profile and list them as separate periods. There are countless threads on this forum that cover this.

Your choice what you do of course.

Even if I go to NY for a weekend? I should split my Canadian experience? Sounds weird.
