Hello Everyone,

I have come to Canada in Jan 2011. I completed my Master's education in April 2012 and then applied for a Post graduation work permit.

So, my study period in Canada is 16 months and I got a work permit for just 18 months.

I was expecting a 3 year work permit, since my "lenght of the program" is 2 years. And I thought the length of the program is considered rather than lenght of study. Is the work permit I got appropriate to my case?

Can I speak to any Immigration people and sort this out or atleast do I have a chance to re-apply. I'm worried because getting a PGWP extension is hard.

Any help is appreciated !!

Hi Buddy,

just a quick question, When is your passport expiring ???

I got a work permit for 16 months cuz my Passport was expiring at that time. After i renewed my passport, i got another work permit for rest of 20 months. If your passport is ok then i guess you should consult with CIC representative or with a lawyer

Hi,

My passport have more than enough validity dude...But do you think the extension process will be tough...I just heard from a friend that the extension will be relatively easy and do not need LMO if the work permit hasn't crossed 3 years. I mean if I got a 3 year work permit, then trying to apply for an extension then I need an LMO...or else, as like in my case now, I got a 18 month permit...I still have 18 months to get to the 3 year mark..so he says it will be easy enough and do not require an LMO...Is that true???

Hi,

How many credit hours you had in your program??....You should definately call the CIC call centre and then try to re-apply again..

To all,

18 month study will give u 3 year wp - if u have it less , u should report it to CIC and get it corrected. For correction no fees - call Tool Free and get it changed. I had this done to one of my aquitance recently. no quesitons asked. as per rules you are eligible so dont confuse urself - just call cic and get it done sooner .

I have Completed 33 credits in 3 semesters. Just to make it more clear...I started it in Jan 2011...Completed by April 2012...Total of 16 months..But in that period of study, 4 months (1 semester) was Summer term and I didn't enroll in University...

From your comment, here's what I make of it:

Jan 2011 - April 2011 - you were in school
May 2011 - August 2011 - this must be the summer term you didn't enroll in school, right?
Sep 2011 - Dec 2011 - you were in school
Jan 2012 - April 2012 - you were in school

Did you study full-time in each semester? 3 semesters = 12 months of study. You can not count that summer term because you were not even enrolled in school.

In my opinion, the visa officer has not made a mistake. Order your GCMS/caips notes - you should find the VO's reason in it.

After the pgwp expires, you need a LMO to apply for a new work permit. Since you were originally hired under the pgwp, your employer does not have to show recruitment efforts(i.e. that they could not find a Canadian or permanent resident who could do the job).

If you are offered a permanent position by any employer in a skilled job (NOC O, A or B), that employer does not have to show recruitment efforts.

i think any program less than 4 semester will not give u 3yrs pgwp. from ur post, u sounds like u completed 3 semester program instead of 4 semester and that might be the cause. well get it clarified by CIC.

You should contact CIC for rectification. I feel the mistake you did may be while filing application you mention months or semester of completed studies, you must have to write "Masters Program of 2 Academic year study", the technical language do make a difference.

Call CIC and post your experience for future applicants.

Also once a PGWP is issued you can't get it extended so whatever your inexperienced friend is suggesting is totally wrong. you will need to obtain LMO to get your work permit extended which will be closed to your employer only.

in person is only in Washington DC office so in canada jsut call toll free, however i do agree with waht senorita posted

I agree with Senorita Bella -

it is not just the length of the program, but how much time you actually spent in the program. To get a three-year PGWP, you would need to have studied at least 2 academic years (4 regular semesters), you only had 3. You received the correct duration on your PGWP.

It is not "difficult" to extend a PGWP, it is simply not an option. To convert to a TWP, you would need an employer to apply for an LMO...

if a person gets enrolled in a two year program , indifferent of how many semesters he's completed it in, he should have the same degree as the person who completes it in one/two more ; based on that, they both should be eligible for the same sort of jobs, hence they both should be granted the same length of working permit. Moreover, the guy who has finished early has done it taking a full load, and the guy who has finished it in 4, well, he just got to stay more with his study permit, so how can that actually be rewarding? makes no sense

i think he is eligible for a re-assessment. CHC websites only venture on "the offficial duration" ... and very few times they say "length of study" which i think is used synonymous with the official length. Anyone else who has had the similar problem might shine some light on it, STURD claims he already did, how about him?
