hi humsafar, i was refused on the grounds of settlemtn funds. but the fact from my aside is i transferred my case from seattle to ND.When i applied i was in canada working. at the time of applying whoever had job in canada need not show proof of funds.so i didnt showed the funds. at passed 6 months i havent got aor from seattle, i was worried as my visa getting expired. so forcibly i had to return india, jobs also not available here n visa extension was difficult. cam to india requested them to transfer my case to ND.I got email from seattle office requesting me to send updated application froms i also intimated abt place change job change etc. but they never asked iasbt proof of funds. In the letter the proof of funds. They transferred on the basis of program integrity.i got aor on 25th may, in btwn i emaled them abt case enquiry they replied pending review nothing has tobe done on ur end. assuming that vo will intimate me abt any docs req. but suddenly i got refusal letter stating that my apps got refused as i didnt showed settlemtn funds.humsafar said:Congrats dear, Can u share what was the problem or reason of ur rejection, there are many who are not aware of your case, if it does not offend u
please.
how many months it took for ur case to reopen? mine was 2 monthsadvisors said:Congratulation to Mastcanada, I also got rejected short time after submitting my full docs in Aug 2009. The rejection was due to submitting proof of English proficiency instead of IELTS.
I wrote to London visa office and within few days they re opened the file and gave me the choice to provide IELTS as they could not award me 16 points for language which I claimed in my application.
I provided IELTS results and process went smooth till I received my visa last Aug.
Congratulations. Though i don't know the details, but rejection is very bad for any one in this process. I pray that God see you through the rest of the process.mastcanada said:Guyz i just got a letter from chc ND requested me to do medicals and they asked me to send passport n rprf.this means that they reopned my file . i always had hope that i will win finally. asked everyone in the forum 98% said no its straight away rejection. just i have not lost the hope.

God ! I had lost hope on my case since I was rejected last month because of my proof of funds also, my big mistake (and I accept that ) was that I sold some assets just before sending my proof of funds, so the bank statements showed all the deposits, I received a phone call asking where the money was coming from and I explained everything and since they did not ask me to prove what I had told, I really thought they were satisfied with my explanation, until I got the painful, rejection letter.....
I tried to get a Lawyer to appeal to the decision since the money is actually mine and it is still on the bank but the Laywer emailed me yesterday saying: " I bill on hourly basis for Federal Court cases at my usual rate of $490 per hour. I estimate that your case will cost approximately $8,000 - 10,000, not including court fees, disbursements and taxes. However, I must warn you that fighting such a negative decision is challenging, costly and the outcome is not certain "
My question is @ Mastcanada, @ advisors and @ SISH7255.... when you say you wrote to CIC to ask for reconsideration, did you email CIC or did you send a letter by regular mail ? Do I have to do both ways to send prove of my funds again ?
Please guys, need your advice since I want to fight for my case...
I would deeply appreciate your comments...
God bless you all !
