Going on vacation while waiting for PR - Inland ..help please

Hello,

My boyfriend is from a visa exempt country and have received first stage approuval and currently holds an open work permit valid until 2015. We want to take a trip down south (mexico or Cuba) over the christas holidays and want to make sure he will be allowed to come back no problem...

From what I have reseach he should be fine but there is always that doubt in our mind...

Should we go or not ???

you'll never get a guarantee that he will be let in again. ANd so it's up t you to decide if you want to take the risk... you have passed first stage, so your file is probably already in the system, and as inland, you're supposed to stay in Canada. So - you might get an officer at the border that thinks that you should have stayed in canada in the first place, and just deny entry. He would have the right to do it, as if you wanted to be able to travel while waiting for PR, you should have apply outland ( even if your boyfriend is in Canada, especially because he is from a visa-exempt country).

He has a work permit, which is only accessible for inland sponsorship. The other side of the coin is that he is supposed to stay in Canada. If he gets refused back in, you'll have to start all over again, outland.

Personally, I would not risk it. too much at stake, and for a holiday... if it was because he had to go and visit family for emergency reasons, you might be able to explain at the border, but honestly, for holidays, I don't think it's a good idea. BUt of course - it's only my opinion, and you can decide to risk it.

You could always take a holiday in Canada :)

Hum... This is why we are ambivalent .. I've called CIC abd they said that it is always at the judgement of the border officer but since he's from visa exempt and work permit they have told me that risk were vety low... Just want this process to be over....

We are days/weeks to get PR but this is the only time we could go away ... Would be stupid to have to start agin but at the sme time no reason why an offiicer would refuse him ....Any other opinion ?

I have to agree with Sweden. There is a reason an officer might refuse:
Leaving Canada can automatically cancel temporary resident status as a visitor, student or worker.

The person being sponsored has no guarantee that he or she will be permitted to return or re‑enter Canada if he or she leaves before permanent residence is approved. This is especially true if a Temporary Resident Visa is required to enter Canada.
If he is not permitted, you will have to start all over again and outland, unless you are able to go to the country he will have to stay, means even more painful process, living apart. Personally, that is not worth. I would be so much happier changing the plan in down south until the next Christmas holiday, or different destination, in Canada, rather than going through the process again and away from my partner. I would not take the slightest risk. Just my opinion.

you must remember CIC and CBSA are not the same even tho they both deal with immigration CIC will say one thing and CBSA another this was told right to my face by a CBSA officer " we are not the same, we protect our borders upfront". In my opinion, I agree with the others it just isn't worth the risk, this is exactly why I applied out-land even tho I remained in Canada the whole 7 months it took to get my PR. Alot of CBSA officers tend to have the "god complex". and the mere fact he left Canada with an In-land application shows them he isn't "following" the rules. There are lots of nice places all over Canada although not warm this time of year LOL

Thank you all for your comments...we decided to stay here :( even if we really do need sun and a vacations ! Just the proof again that CIC have a lot of power on our lives...

Now we just hope for loads of snow for Christmas so we can go ski :)
