Going on a holiday while waiting for an inland application - is it risky?

Hi,

Me and my partner applied for a PR (I'm sponsoring him), and we are thinking about going traveling for 2 months next year. We are planning to quit our jobs, and then come back and look for new jobs, and will have a lot of savings.

The timeline is: we sent the package to Mississauga on September 13, received confirmation of receipt November 22. My partner's Work and Holiday permit expires in January, and we thought we would wait for his OWP and then plan our trip, so that he could leave and come back to Canada.

Do you think it would be risky to do that holiday while we are waiting for the decision? If we explain all our plans and outline how we're planning to do the trip and show our savings, could it still jeopardize the application?

Yes two months is too long, if travelling is important you guys shouldve applied outland

FYI - OWP doesn't guarantee re-entry into Canada. Agreed that leaving for a few months is too long if you have applied inland.

Inland applicant and sponsor should live together in Canada during entire processing time. So a 2 month long trip outside Canada is too much and you will be risking your the application. Good luck!

My husband and I applied around the same time as you and have just been the USA for nearly 2 months. I am Canadian, he is American and we have a baby (born in Canada in April). We are still waiting for his open work permit but he has received an extended visitor status until December 31.

2 risks.
1. If the visa officer notices sponsor and/or applicant has left Canada for an extended time, and feels either one is no longer residing here, they would have grounds to reject the inland application. What time would be allowed, is at discretion of the visa officer.
2. If upon re-entry to Canada CBSA decides to give your partner any problems at the border and for any reason denies him entry, the inland PR app would be cancelled.

There is a good chance you could go on vacation and nothing will happen, and app will simply continue when you return. Or there's a chance one of above 2 risks could happen. Up to you if the travel is worth it. As mentioned, those that want to travel during the process are supposed to apply outland.

If you applied inland, the app would be in danger of being rejected since you are not living in Canada right now. Both of you need to return to live in Canada immediately.

Thank you, we will be returning in a few days. We decided to take the risk as we had family wanting to meet our baby. We have all of our support and life in Canada so hopefully the risk was worth it and all goes smoothly.

Thank you everyone for your advice! I asked an immigration lawyer I know, and he also advised us not to travel.

if you have a visitor visa and a trv stamped on your passport then i think you can travel without any problem.thats what my lawyer told me since i need to go backhome also.i got my visitor visa and waiting on owp now.he is gonna apply for my trv once i get the work permit for that he needs my passport.is that right?

another question i wanna ask is whats the timeline for police clearance.is it okay to sumbit it a year later and how long its taking the inland appliera?

With inland applications you are advised not to travel. If you are denied reentry to canada your pr application is considered as abandoned because one of the requirements for inland sponsorship is that you must be living IN Canada. That's impossible if denied entry.

A visitor visa become null and void as soon as you step out of Canada.

I can't comment on that but that is the guidelines with inland applications.

Everything is at your own risk as nobody on here will be able to give you a definitive answer. You are unfortunately at the mercy of the CBSA officer and the person handling your application.

It depends on how much you want to risk your application for the trip.
We applied inland and actually had our honeymoon in Canada because we didn't want to risk crossing the border.
He is from a visa exempt country and theoretically should be OK to cross the border. But again, we didn't want to take any risk.
I am happy with what we did. Montreal was beautiful and food there was great.
