Girlfriend's Visa Refusal

Hey Everyone.

I recently applied for a Visa for my girlfriend of 5 years to come to Canada with our 3 year-old son so our son can see Canada and be with his older brothers over the Christmas holidays. Unfortunately, the application was refused. I am not surprised as it took 14 months just to get my son's citizenship certificate so I have ZERO faith in the IRCC.

The reasons the officer gave were as follows and left me very perplexed.

I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) (https://laws-lois.justice.gc.ca/eng/acts/I-2.5/index.html) and Immigration and Refugee Protection Regulations (IRPR) (https://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/ index.html). I am refusing your application. • I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 179(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/ section-179.html). I am refusing your application because you have not established that you will leave Canada, based on the following factors: • Your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable). • The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.

The assets and financial situation should not come into question as I stated in my invite letter that I would be looking after all expenses and accommodation for them during their 4 month visit. I already have the airline tickets...WTF! Me gf is close to her family and a decision on whether she would want to move here wouldn't be made during one visit. This decision not only denies my son's rights as a Canadian to see his brothers, but also the rights if his brothers to spend time with their little brother.

What else can I do? They said I can re-apply and that application would be "viewed upon it's merits" but one of the questions asked in this process is has there ever been a denial for a Visa application from any country. I don't mind re-applying but I want to ensure that the process is fair. We let thousands of people into this country every year who have absolutely no desire to return to their home country and it just angers me that the IRCC agent, who could be biased him/herself can solely make that decision.

Is she really coming to visit? Are you still in a relationship? If you are common law then you should be sponsoring her for PR.

Yes, she is really coming to visit! We have been together for 5 years and we are unsure where we actually want to reside. I have been going down regularly, sometimes twice a month for the past 5 years. The stays have been longer since our son was born. I have three sons with my ex...two of them met their brother when he was three months. I want them here to experience Canada. I want them to spend Christmas here so the boys can bond more. I mean, I could have lied about everything in the application and got it approved, but I told the truth as I should. Going through the process to get our son's citizenship was ridiculous. It took over a year even though he "gets automatic citizenship" through me as a born and raised Canadian. I honestly think getting our son his Canadian citizenship was actually a hinderance to this process!

Absolutely having a Canadian son doesn’t help her approval. What also didn’t help was her wanting a 4 month visit (there are no ties to return, too long) and not showing her own funds.

In my Invite Letter I made it very clear that I would be covering all expenses for her and our son. Are you suggesting that I re-apply and only state a two week stay?

Our son's birthday is in September so I want to have his birthday here AND celebrate Christmas here. I guess when I look back at it...I should have said two weeks..lol...once we get the Visa she could stay as long as the original 4 months..lol

That’s not how TRVs work. The visitor must show their own funds and ties to their home country.
