A Canadian Federal Court has ruled in favour of visa applicants waiting to have their visa's processed and fearing they would not be rejected without processing.
The federal court has directed the Ottawa immigration authorities to process all the Canadian skilled worker visa applications filed before 2008. This decision will help over 300,000 families worldwide get a chance to settle in Canada after suffering major professional, financial and emotional setbacks due to the lengthy backlog of their applications, ranging five to nine years.
About 900 applicants who had suffered from government decision to reject the applications filed prior to February 2008 filed a case against Immigration Minister Jason Kenney for violating the pledge to assess and finalise decisions in a timely manner.
"The ruling is a positive sign for these 900 applicants who can now hope to realise their dreams of settling in Canada once again" said Chandigarh-based immigration expert Col BS Sandhu, "I am happy for these people and their families as their applications will now be processed in a timely manner."
The proposed decision by the Canadian government to return all the applications filed before the end of February 2008 dismayed Canadian immigration aspirants across the globe waiting for visa approval.
