Full Docements sent without IELTS TFR. Help needed.

I am under Old NOC 0213, full docs sent by my consultant without IELTS TFR, becasue he told me its not enough (5.5 bandS) to get full points, he wrote letter to CHC that I have health and family problem so I not sent IELTS TFR, he said to me try to clear your IELTS for get 16points, my points is not enough with 5.5bands. the CHC recieved documents on 12/August/2010.
what is the chances for in-process.

Well if you didn't submit IELTs and you didn't submit a written explanation of your language abilities, you are going to have a problem as your application is incomplete. So what is your intention?

my intention is I am trying to submit best score and have exam date fixed too.

Repeat exams wont matter. However there is a high chance that an application may be rejected because of incomplete application. There are even cases where application was rejected on the basis that a form was not filled.

Just wait and see. Maybe luck is on your side.

I wonder why the info provided by you here is in contradiction. In your time line you state you got 7.5 band and write 5.5 band now.

Anyway visa office require your proof of language proficiency, you still have a chance to send now, buffalo visa office is slow and they may not pickup your file for some time, you may have one final shot at IELTS. with 0213 not on list anymore you dont have second chance. In the absence of qualifying points visa office is likely to reject your application.

typo mistake corrected now... its 5.5 sorry, but I will send new result when I get it, exam will be on august 21, 2010.
