FSW program - List of priority occupations to be announced in April

Hello,

CIC just announced today that sometime in April they will reveal, amongst other things, a list of priority occupations. My question is: if my occupation (I am a lawyer) is not one of the accepted ones from the list, would I still be eligible to apply for FSWP? Or only the occupations from this list will be accepted?

Any help with this would be appreciated.

It depends at the time of actual announcement that what rule is applicable to you. Just wait for April.

Actually, CIC announced that a few weeks ago. If your occupation is not in the list, you will not be eligible to apply. That's the whole purpose of having the list.

The OP does not mention that she is applying with a job offer so I assumed she is applying without it and hence my answer, keeping it relevant to the question.

Thank you all for your responses. Actually there is no job offer :(; however I thought that since it says "priority" occupations, you would still be able to apply, and the applicants with occupations from the list will have priority, depending on the cap on the number of applications to be accepted. Based on the information provided by CIC thus far I thought only these requirements have to be met so you can apply: at least 1 yr FT paid work experiance in the last 10 yrs; adequate-intermediate language proficiancy in English; min 67 points on the reworked point grid; and foreing credentials assessed. So the occupation list is new and thus a bit confusing if it will contribute to your eligibility to apply.

But you're right, will wait till April and go from there.

I just noticed this thread ..it's relevant to some info I was seeking on another one.

So would it be safe to say ...if you have a job offer (as you stated), or you are already currently working in Canada on a temporary 3 year work permit in IT, you would be eligible to apply on May 4th this year, regardless of what that list will say ..?

Actually, the occupation list is not new. There was one previously (2011-2012). The rules are very straight foward. Your occupation needs to be on the list if you want to apply. If your occupation is not on the list, you cannot apply.

You should assume that your occupation will not be on the list. There is no shortage of lawyers in Canada. If you wish to immigrate then you should either look into one of the provincial nominee programs or try to secure a job offer in Canada so that you qualify for the FSW with a job offer stream.

If you are working in Canada on Temporary work permit, you can apply for PR anytime under FSW2 category. You dont have to wait for May.

If you have a permanent job offer and a positive AEO already, you can apply through FSW right now, no need to wait until May. If you are already working in Canada with a work permit and you have already worked for at least one year in Canada, you can apply through Canadian Experience class (CEC), again no need for FSW. To apply for FSW through job offer stream, the job (or the offer) has to be permanent. Read the following links to learn what would be the best option for you:

Thanks for the explanation .. but this is again a little different from what was said earlier .. about the conditions under which one can apply ..perhaps I'm reading too much into it ..

But yes, I've read the article ..just need clarification ..and appreciate your patience with this, I think it could end up helping a lot of people here ..

Are you saying if you have a temp 3 year work permit, and you are currently working as a systems analyst in Canada, you can apply right now..IF your employer has given you a letter of permanent hiring after your PR is processed, and IF you have been working for a year for this employer ..?

Now, I've been working since Sept, 2012. It hasn't been a year, only 6 months and change .. does that disqualify me from applying now?
I'm a US citizen, and have 12 years experience in my IT field back in the States ..
What I have so far for documents are the following:
- My employer has given me a supporting letter to hire me permanently after PR is achieved.
- My job title is systems analyst for Canadian immigration category purposes.
- I fall under NAFTA treaty of employment between Canada and USA.
- I have my FBI clearance, and all supporting docs needed, basically my app is complete at this point.

Based on that info, can I apply now ..?

You have no reason to worry in that case. It seems you have everything you need for FSW. Since you are working under NAFTA, you are also exempt from AEO or LMO. You can apply right now for the FSW program. The one year canadian work experience is for a different program (CEC), not for FSW. So, you are good to go!
