Hello Members

Greetings!

Some Background about my question
My name is Sushant and I am an Indian citizen working on H1B in USA for the past year and a half as a Software developer (Seattle based). My widowed mother lives in India (as there is nothing in the US laws that I can use to get her here to live with me) and I am her only son, so I can't keep her alone in India for long. I either need to move back to India within the next year or so or get her here with me.

This gave me the idea of settling in Canada. I am well above the 67 points needed for PR even without a job offer, but as far as I could understand, having a job offer could make things a lot easier.

Here is my question:
Let's say I get a job offer from a software company in Canada, how soon can I get a PR? Do I need to get a temporary work permit first and then apply for PR?
After I get my PR, how soon can I sponsor my Mother for a PR? Is it easy to get a Super Visa in the meantime for her? (She does not have strong home ties as I am her only son. We do have a small house in Delhi). My mother is around 50 and works in a school and also has a law degree, but I don't necessarily want her to work in Canada.

I am trying to gauge the approximate timelines regarding when my mother could be in Canada, if I were to get a job offer let's say tomorrow. Please let me know if I should rather get legal help on this (is so any recommendations would be greatly appreciated).

To be approved for a Super Visa, your mother will have to demonstrate that she has strong ties to her home country. I don't think any of us can tell you if your mother will be approved or not.

Once you have PR, it will take several years before you can apply to sponsor your mother and several more years for the application to be processed. To qualify to sponsor your mother for PR, you must provide three consecutive years of Canadian tax returns where you meet the low income cut off to sponsor your mother. So you'll need more than three years in Canada just to qualify to apply to sponsor your mother. Once the application is submitted, I would expect that it will take at least three years to process (current processing times are much longer but CIC is saying they are going to be reduced). So once you have PR, it will likely be a minimum of 6 years (quite possibly longer) before your mother will have PR.

It's your choice if you get legal help.

That is exactly the information I was looking for, thanks a ton!

Another question I have is "What is the earliest one (I) can get a Canadian PR, assuming I take the fastest possible route and under ideal circumstances?" (again approximate times like your last answer would work). I have been searching online and it seems like having a job offer is the fastest way to get a PR, but I couldn't find the time frame corresponding to that fastest.

I think if I apply without a job offer, it's anywhere from 2 to 3 years right? Again, I do have the points even without a job.

You need a job offer. Even if you have enough points, you don't qualify to apply without a job offer. The job offer also has to be permanent. I would say you should expect to wait 2 years to get your PR.

Software Engineer would qualify to apply for PR as Federal Skilled Worker only if you have a valid job offer. If your company allows internal transfer based on their requirements in Canada, that would work as well, and probably reduce your timeline. The timeline may improve further slightly if you have provincial nomination.

But a timeline of 2 years as advised before would be a good ballpark number to plan with.
