my immigration application under federal skilled worker caetgory (phd stream) has been refused.
I received email from cic 'Although you indicated on your application form that you intend to reside in Calgary, Alberta, you currently live in Montreal, Quebec. I am concerned that you do not intend to live in a province other than the Province of Quebec. Therefore, please submit information and/or documentation that would allay this concern within 30 days from the date of this letter''
i submitted an offer from an professor from Calgary university ,Alberta
my email to prof- ' dear prof.. I am a Ph.D. student at the Department of Gienie Mechanique - Ecole Polytechnique De Montreal. My area of expertise is manufacturing/automation. It would be great if there were any project on manufacturing/automation where I could collaborate with your research group.I want to enhance my research career working as a guest researcher/visiting graduate student with your team at your University. If there is any available position, it would be my pleasure to collaborate. I am enclosing my CV for your perusal.
Prof response to me-‘ Dear ...., Thank you for your interest to be part of my research group. You seem to be a good student with the right set of credential. Thus, I will be very interested in reviewing your credentials for a potential collaboration.
I'm always in search for good fellows and I anticipate that I will be recruiting students as well as a post doc for the Sept 2015 acedemic term.
You seem to be a good student so I look forward in looking at your appplication. Obviosuly I will have to tlk to my team to check out the specific projects where we will need help.'
CIC refused my application stating 'Although you indicated on your application form that you intend to reside in Alberta, you currently live and study in Montreal, Quebec. Furthermore, you have not completed your course of study at Ecole Polytechnique Montreal. On December 17, 2014, you were sent a letter outlining these concerns and you were provided with 30 days to respond to these concerns. On December 19, 2014, you responded by stating that you did not want to remain in Quebec as you have received an email from a professor at the University of Calgary to be part of his research team. You also indicated that your spouse cannot practice dentistry in Quebec because she is not proficient in French.
I am not satisfied that you intend to reside in a province other than the province of Quebec. You are still studying and living in Montreal. The evidence submitted does not satisfy me that you are taking concrete steps to reside in a province other than Quebec. The email you provided from Professor ..............., acknowledges that you requested to be part of his team however suggests that you apply for a fellowship beginning in September 2015. You have not provided definitive evidence that you will move to another province in the near future. '
What can I do in this situation?
Judicial review can bring any positive result? does anyone has any previous experience with judicial review like this type of situation?
