I dont think Khaleesi is worried about the fee refund, he is looking at other options to meet the eligibility criteria, please correct me if I am wrong.

Yes you're right Staind. I'm also confused because my status in ecas shows in process.

A maximum of 25,000 new, complete FSW applications will be considered for processing under the occupation list stream for the period of May 1, 2014, until April 30, 2015, unless otherwise indicated in a future Ministerial Instruction.

I hope they dont do any Ministerial Instructions :-[

If you stretch the concept, they may as well cancel the FSW program tomorrow... but it doesn't look like that's their objective.

IMHO they really don't know yet how well will EE entry work, and they have quite a bit of pressure from Canadian companies that need to hire skilled immigrants.

So they are giving themselves the first 4 months of 2015 to work on the EE so it works as well as they need it.

It shows in process, because, the file was placed into processing. I guess the status might change soon to decision made. In the meanwhile, see what you can do to increase the points to 67 and reapply. Sorry about your situation and wishing you the best of luck.

CIC finally decided to update the website!!!!

If you received NER you status will change to Decision Made in few days.

I'm sorry I misunderstood your question Khaleesi.

ECAS is a pretty dated system, and they may take 1 week or more to update your status. Since your NER is recent, that may be the cause.

If you wan't to apply again, you will have to get some extra evidence to support the necessary 67 points and pay the processing fee again.

How were your points distributed? Do you know in which criteria they didn't gave you all the points you thought you had?

The New 'Express Entry' Model

Under the new system to be implemented in January 2015, the process will cease to be applicant driven. The process will be government driven. Full details are not yet available, but the process would require applicants to file a profile, which signifies to the government that they are interested in permanent residence, and which would set out their backgrounds. CIC, on grounds which are also not yet clear, would then select those applicants it thought were 'highest ranked' and who had arranged employment (or a provincial nomination). These applicants would be invited to apply for permanent residence, and would have 60 days to file their applications.

No longer will applicants be processed in a first in/first out system, and no longer can applicants know that they have met the criteria through clearly established guidelines. Rather, as noted, CIC will choose from among the pool of prospective applicants, only those applicants it wants to process. Further, applicants who are not invited to apply for permanent residence will be removed from the pool of potential applicants after 12 months.

Impact

As it stands, this new system creates uncertainty. No longer can an employee know with certainty whether he/she can become a permanent resident, and no longer can an employer know with certainty that he/she would have the ability to retain a particular desired employee. Though further details may clarify some of the issues, it would seem apparent that the new system gives CIC a large degree of discretion, and as such, the inability for employers/employees to plan for their immigration issues.

What do they mean for failed on selection? Anyway, thanks Orange girl!

You are welcome. Failed on selection means didn't meet criteria for being selected,in other words didn't satisfy the officer that he was able to be economically established in Canada. It's just their policy, you have to have 67 points, although in the past officers had authority to assign extra points based on other factors, now it's all by the book. We've been in Canada for five years, we are pretty established here, went to school here, both of us are working and have no problem with English, but it's still hard to pass their eligibility review. They don't care how long you've been in Canada, all they need is to see that you have enough points in those six selection criteria.
