Whether the cap for NOC 2174 will be filled by the time you submit your application is a question that no one can answer. I suggest that you send the application and hope for the best. Should your application reach CIC after the cap is reached, they will return your application - the application fee will not be charged. All you stand to lose is the courier fee. Remember, that ECA and IELTS can be used for express entry system which will begin on the 1st of January 2015.

I have asked this question many times in multiple forum nr2579, and the reply i have got is its not necessary, just get the PCC from your current state/city of residence and you should be good to go.

I would advice you to fill the PCC application form with marital status as Single and it would work for you. They issue the PCC within a couple of hours.

PCC from Canada is not required for FSW application.

Notarizing is not required for these copies, unless these are translated to English/French.

If you already have the PCC with you, add that in your application package.

Are you also reading the question the same way I am? I am also reading it as it asks whether I am convicted and if I am currently being subject to cirminal proceedings. The answer to both is NO.
But if I select NO, when I submit my PCC from US (which I am not submitting with my application) during the visa office stage, the arrest record and the charge will show up. Isn't it going to be a misrepresentation issue?

I've read on several occasions on this forum that CIC wants to complete processing FSW applications before the express system begins in January 2015. Can anyone provide a link from an official source that this is the case?

YES ofcourse i will update. Trying to update as early i can, planning to add MR & transfers to Vo section... from next week.
or probably 2 separate updates week 1/2 & week 3/4...

the reason i started this, is there are many ppl, asking the same question, when will be mine...? i m this date applicant ...still nothing...am i out ?
these creates negativity in them, so thought of having a rough draft here, so atleast looking to these data, one can get an approx idea to being in RACE and POSITIVE HOPES around - encouraging each other... 8) 8) 8)

Please kindly advise me on my situation.

I am also applying for FSW 2014 program. I have one issues related to my background information. As a result of some stupid mistake that happened a couiple of years ago in the US, I was charged with loitering, but eventually the charge was dismissed in the court. So there is no conviction record.This dismissed charge and the arrest record will show up on the FBI check.
I have consulted with a lawyer on this issue. According to him, a charge of loitering will not make me inadmissible to Canada. Even if I were convicted(and I am not), I would not be inadmissible to Canada because it is a summary conviction offence in Canada.

But my question is related to the Background/Declaration form. The question 6b states the following: Have you been convicted of, or are you currently charged with, on trial for, or party to a crime or offence, or subject of any criminal proceedings in any other country?
In my understanding the question addresses two things:
1) conviction
2) whether I am currently subject to any criminal proceedings.

Should I answer Yes or No to this question?

My lawyer says that I should select Yes and proceed with explanation.

But I am inclined to select No and then, provide explanation below stating sth like " I have been charged on such date with such an offence and it was dismissed ...etc". But if I select no and the charge appears on PCC, isn't it going to be an issue with the visa office?

What do yo think and suggest on my situation?

Don't worry sister. If I get PER with the old form, why you won't get with the same though at that time it was changed. Consider people who sent application through normal post whose file received after 10-25 days of sending and in between forms have been changed.

For peace of mind, do send a revised and updated forms with cover letter about the changes.

Hi All,

I seem to have made the same mistake made by this person in the below quote from another forum thread...
I had downloaded all the forms from the web somewhere around June 1st or 2nd week and used those forms when i sent my document package in the first week of August..... I verified now that there are mainly 4 forms concerning me that have changed since...

1. Document CheckList IMM5612 (August 2014)
2. Generic Application Form IMM0008 (changed on 15th or 18th June i think)
3. Schedule 3 Economic Classes IMM0008 Schedule 3 (August 2014)
4. Fee Payment Form (August 2014)

My main cause of concern is the "Generic Application Form". I compared all other documents and the changes are minor enough not to affect my document.

However in the "Generic Application Form" I could spot three main differences as stated below:
1. Under heading "LANGUAGE DETAIL", Question No. 3 is added for both principal applicant and Spouse, which was not present in the older form. (I think this may be a deal breaker for me, as it may be considered as an incomplete information in the main form ? :'( )
- Have you taken a test from a designated testing agency to access your proficiency in English or French ?
2. Under "Consent and Declaration of Applicant" and new consent question is added. (This i think should not impact my application... ???)
- Do you consent to be contacted by CIC, or an organization at CIC's request, in the future ?
3. The barcode's that are generated after the document is validated seems to have a timestamp which is different from the timstamp in my barcode page i submitted. (If they use a different barcode reader for the new app, then it may be considered as an invalid app right??? sigh!! :-\ )
- New format IMM0008_07-2014_x whereas the old format generated as IMM0008_03-2014_x

What do you guys think of the above...? I saw FSW 2013 and one of the common reasons for return of application there was "Applicant used outdated Schedule 3 form" :o ??? :-[

In how many days have CIC responded to earlier emails?

I had sent an email on July 26 and haven't heard from them. That time it said 30 working days (6 working weeks). Excluding Stat holidays and weekends its almost 28 days now. :'(
