Its not a mistake at all. You sign at the end that all claims you make are to the best of your knowledge, and this wasn't foreseeable as a mistake. So under the Principle of "Duty of Care" (Auditors would know ) you are fine.

Hi , I have sent my application with noc 2132, on 18 aug 2014 from india,

My son's ( 7yr old) , passport was issued from indian consulate from Dubai 3yr back,

in my generic IMM0008 form I have mentioned, passport - country of issue as UAE, instead of india.
is it a big mistake, will they return my application.

what to do, very tensed,,,,

Guys need URGENT help!!!

Today I got this devastating email from CIC. Any idea how to interpret the highlighted part.

Subsection 75(2) of the Immigration and Refugee Protection Regulations states that a foreign national is a skilled worker if:

a) within the 10 years preceding the date of their application for a permanent resident visa, they have at least one year of continuous full-time (30 hours/week) employment experience, as described in subsection 73(1), or the equivalent in continuous part-time employment in the occupation identified in their application as their primary occupation, other than a restricted occupation, that are listed in Skill Type 0 or Skill Level A or B of the National Occupational Classification matrix;

b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification;

c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties;

d) they submitted the results of an English or French language test issued by a designated testing agency indicating that they met or exceeded the applicable language proficiency threshold set by the Minister for each of the four language skill areas; and

e) they submitted their completed Canadian educational credential or their completed foreign educational credential and the equivalency assessment from a designated organization of institution that is less than five years old on the date of application.


I am not satisfied that you meet the minimal requirements pursuant to R75 (2), specifically part e) of the above requirements because you have not submitted evidence of completion of a Canadian secondary educational credential (or its equivalent), in accordance with R75(2)(e) and R75(8 ) of IRPA. The World Education Services (WES) Credential Evaluation and Authentication Report (change as appropriate) provided indicate the Canadian Equivalency Summary as Three years of undergraduate study. This equivalency assessment does not demonstrate that you have completed the equivalent of a Canadian secondary educational credential.

In that case you can reapply with a photo copy of your IELTS along with a copy of your refusal email .

Refer to an excerpt ("Guidelines")

Note: You are permitted to submit a copy of your language test results with a new application only if your original test results were submitted with a previous Federal Skilled Worker Program application that we did not return to you. If you provide a copy of your language test results, you must include a photocopy of the refusal letter you received from us and an explanation that CIC currently has your original language test results.

they were very clear on that : "Your application and supporting documentation are part of your permanent record and must remain on file. Original documents, submitted in support of your application, are also part of the permanent record and will not be returned. Once your application has been placed in process, no refund of the processing fees will be issued."

They normally provide you with a timeframe. Supposedly 3 months just like medicals.

I would ask an opinion from others who have gotten PCC and Medical Requests.

It is WES ' Credential Equivalence methodology (at fault ??- may or may not) which has NOT recognized your qualification as a (post-secondary) degree or diploma and hence CIC rejected your Application. 8)

All I would suggest you is to get your ECA done from another agency (ICAS or CES) and based on their assessment (10+ weeks) - if they recognize it is a "degree" apply again. (In the meantime you can also followup with WES to reconsider their assessment as a 'degree')

please help....my employer has written full time on my experience letter instead of no of hrs....would that effect my application...and one more thing my file was sent on 23rd aug and delivered to cic on 28th aug..as per dhl courier...but my IELTS 2 yrs is till 21st sep...will that be fine...plz answer both questions...plz

Nope as long as it is written as full time.

Wait for your PR 8)

And for the ielts its fine as they recieved your application before expiry. They might request you for another test at a Later stage. It is at the Visa office's discretion.

I think its the quality of the courses studied during the degree programme as well as the prerequisites to enter that programme. My 3yr degree was assessed equivalent to canadian 4yrs. In order to be accepted i had to pass at least 4 subjects at an advanced level. So its a combination of factors. Just like institutions all degrees are not equal.

And determining factors could be: rank of university , how much you scored in that programme as well
U have to calculate points on number of years studied as per wes .. 10+2+(3 or 4 or 1) stated as on report

1. 'Full time' is acceptable.
2. As stated in the checklist, language test result must not be older than two years upon date of recipt at CIO. So I would say your IELTS result is still valid.

Wes does not give any points .They give equivalancy to canadian education .You have to get points by looking at points grid.
