Really? I don't think even you have UCI number after cap reached, it is not refusal I guess. The application is inadmissible because of the cap, but I don't think it was refused. Any thoughts?

No you have to write 'NO' since you are not inadmissible

What do you mean? So regarding the question of the poster above even if he has UCI number, he should still write "NO". What do you think?

ofcourse I also don't agree to it as the applications were returned back not refused
refusal is different return back is different
but yes it is confusing though

This is where most confusion lying with most of the members of the forum who are applying for FSW 2014 since the application for FSW 2013 was returned due to CAP reached for their respective occupation.

Yes even if you have UCI no you should write 'NO' because if your application returned due to cap reached or incomplete application that doesn't show that one is inadmissible

One is inadmissible to Canada if he has:

A criminal record
Fake document/identity
Certain Medical conditions that might not permit him entry

I believe it is all ways better to write "Yes"and mention the reason Application was refused since CAP reached for the respective occupation. The Visa officer always go with honesty and no harm in doing so.

This is my perception and it is not mentioned any ware in any rule book

My consultant told me that "refusal" is different from "non-eligibility" (due to cap). Just come to think of it, where that particular question is classified in question 6. "Refusal" is quite a strong word, isn't it?

I agree we are not lying to them that we were refused to enter Canada
an application is returned due to various reasons incomplete application cap filled or not full 67 points etc
but refusal is like you are not allowed to enter Canada due to some reason
I believe the word refusal will come into play only after your application was processed and then you were refused
write now our applications were not at all processed they were simply returned due to cap

this is my opinion and I have ticked no
