I got my WES evaluation report for FSWP credential assessment which states that my degree''s canadian equivalency is Three years of post secondary study at a non-recognised institution. Does this makes me ineligible to claim points under FSWP? Please help.

Every year, thousands of applicants for permanent residence in Canada have their applications refused for a multitude of reasons, many of which are entirely avoidable. These unfortunate situations typically result in much disappointment and distress for applicants and their families. Canada provides numerous immigration options for foreign nationals, but navigating the processes in place can sometimes be challenging. Here is a list of seven common reasons why people get refused for permanent residence in Canada, which should help anybody thinking of, or in the process of, immigrating to Canada.

1. Misrepresentation

Some cases of misrepresentation originate from the applicant either misreading a question on a form, omitting items of information from a form, or misunderstanding the instructions for completing a form. While the term ‘misrepresentation' may seem to imply a deliberate attempt on the part of the applicant to conceal or distort certain information, this not always the case. Some instances of misrepresentation are accidental and preventable. The result of this transgression is not only that the application is refused, but also that the applicant may be banned from reapplying for two years (five years for Quebec applications).

2. Health

All applicants for permanent residence in Canada and their dependents are required to take a medical examination with a doctor recognised by Citizenship and Immigration Canada (CIC). Certain health issues may result in refusal. Applicants for permanent residence who require medication for Diabetes or Hepatitis A, for example, could be deemed to be a potential burden on Canada's universal healthcare system, and CIC reserves the right to refuse an otherwise eligible application for permanent residence on health grounds. There are, however, ways to overcome inadmissibility on health grounds. For example, a report from a specialist on the condition could help an applicant's case and help to avoid further medical examinations, delays and/or refusal.

3. Criminality

Criminal background checks from every country the applicant has resided in for six months or longer since he or she turned 18 years of age are mandatory. Canada understandably wants to ensure that immigrants to its communities do not have a criminal background that could potentially threaten the health and safety of other residents. If you don't have any charges or convictions in your past, this stage is just about getting the paperwork done. If you do have a past criminal offence on your record, however, this could present issues during your application.

A foreign national may be criminally inadmissible to Canada on the grounds of serious criminality. For an applicant with a past conviction on his or her record, learning more about criminal inadmissibility, as well as the difference between deemed rehabilitation and individual rehabilitation, is key. Consulting an immigration lawyer with experience in issues pertaining to criminal inadmissibility is always a good idea for such applicants.

4. Missing a deadline

Citizenship and Immigration Canada (CIC) attempts to make the immigration process faster for applicants by imposing deadlines for the submission of certain forms and documents. Missing one of these deadlines, however, could result in an application being refused. Therefore, knowing how and when to obtain certain documents, and how and when to complete certain forms, is hugely important. Missing a deadline is usually avoidable, so being prepared and organised before and during the immigration process can make the difference between immigrating to Canada and having an application refused. While CIC will occasionally grant extensions, it is important to properly explain the grounds for extension and give reasons and/or supporting documents.

5. Reconsiderations — CIC makes mistakes

In most cases, CIC follows its own procedures and rules in a straightforward and consistent manner. Visa offices, however, are capable of errors and/or inconsistencies in their work. It is possible that they can misinterpret the law and refuse an application on unjustified grounds. Hiring the services of an immigration attorney can mitigate these factors. The attorney may be able to build a case based on established precedents similar or identical to the situation faced by an applicant who has had his or her application refused, and then represent the applicant in a case for reconsideration or appeals to the appropriate court.

6. Failure to attach documents

CIC provides a thorough but clear list of documents required of the applicant, as well as a tracking number, in order to bring an application to completion. It is up to the applicant to locate these documents and submit them to the correct CIC office with the tracking number. Failure to do so could result in the application being refused.

7. Applying without knowing eligibility requirements

Canada offers more than 60 immigration programs, each of which is unique. Depending on a number of factors, such as a person's age, education, net worth, occupation and work experience, he or she may be eligible for one, more than one, or none of these programs. A superficial glance at the criteria for a given program might lead to an applicant believing that he or she is eligible, but it may be the case that he or she is not, in fact, eligible for that program. A detailed review of the application criteria against the applicant's credentials is needed to assess eligibility for an immigration program.

Some applicants see their applications refused because they are not eligible for the program for which they have applied, even though they may have been eligible for another Canadian immigration program. This situation is preventable if the applicant correctly determines his or her eligibility for Canadian immigration before making an application in the first place. Failure to do so is often a waste of time, energy and money for the applicant.

Final Chance For Current Federal Skilled Worker Program

“Candidates still have time, but they need to move fast. In practical terms, they need to determine their eligibility today and, if they are eligible, they need to start the process almost immediately,” says Attorney David Cohen. “Candidates who fulfil the criteria of the current Federal Skilled Worker Program should apply now, knowing with a degree of certainty that they will be able to immigrate to Canada.”

After December 31, 2014, the current rules and procedures for the FSWP will no longer be in place.

What comes after the FSWP?

As of January 1, 2015, candidates will no longer apply directly to the FSWP. From that date, Canada will transition to a new expression of interest immigration selection system called ‘Express Entry'.

Under Express Entry, the federal government and provincial governments, as well as Canadian employers, will be able to select potential immigrants from a pool of candidates who have declared an expression of interest in immigrating to Canada and who meet the eligibility criteria for at least one of Canada's economic immigration programs:

The Federal Skilled Worker Program
The Federal Skilled Trades Program
The Canadian Experience Class
A portion of the Provincial Nominee Program

The highest-ranked candidates (those deemed to have the best chances for economic success) may then be invited to apply for permanent residence in Canada under one of these programs.

“From January, candidates will be relying on being cherry-picked by either the federal government, a province, or a Canadian employer. Now is the time to take action,” says Attorney David Cohen.

Now I am confused :) Maybe they have changed the procedure.. I double checked my documents now and I am sure that applied with my married surname. I applied in August 2013.. In my application there is a section called "Previous Name" which includes my maiden name and surname (probably i filled this section, I don't remember)

A WES evaluation report is always issued under the name indicated on the academic record(s).

This is getting me confused.

The worse scenario is that Visa Officer will overrule the previous PER decision and may reject the application before starting the process, in this case, you will see “Decision Made” in your ecas. *For FSWP 2013, we are hoping that this may not happen as everything has already been screened at CIO.

From here on, everything will be verified and cross-referenced. This includes and not limited to your experience letters, salary stubs, visiting cards, employment offices, relative documents [if applicable], passport verification, IELTS verification, national identity cards verification [if applicable], your educational documents, marksheets, your background declaration, security checks and so on. They may or not may not visit, call or email your current / previous employers. It's totally up to them.

At this stage, the visa officer MAY call for a face to face interview at your local visa office. In case of remote visa office, the RVO will inform you about the due date and time and the location. Visa officer will clearly mention in the email about the reason of the interview so that you can gather required documents to back your original case. You will not be informed about the outcome of the interview on the spot but the next step will let you know how well you performed. NOTE: Visa Officer will not judge your English Language ability in the interview.

IF everything goes well, you will receive a Medical Call. IF an interview goes well and you managed to satisfy the visa officer, you will get the same result. At this stage, your ecas will still read “In Process”.

IN CASE something goes wrong with or without interview, you will get “Decision Made” at your ECAS which means youre no more eligible for PR processing and you will get a rejection with a letter mentioning the reasons.

After you receive Medical Call, you will have to undergo Medical Examination at your local DMP [Find your local DMP HERE]. You and your dependents have to satisfy the visa officer that you are medically fit to be admissible to Canada. Once your results have been received by the Visa Office, your ecas will read, “We have received your medical results on mm-dd-yyyy” and the status will remain “In Process”.

You or one of your dependent may get a re-medical exam if there's a doubt about something that they think need to be reverified.

The next step would be [and not limited to] Passport Request, any additional or updated documents, new Police Clearance Certificate etc and Right of Permanent Resident fee [RPRF] which is $490 for each Principal Applicant and Spouse [if applicable]. You do not have to pay RPRF for your children.

Once everything is done and your payment cashed, your status will be changed to “Decision Made” and the address will be updated with a Canadian address & you will receive your Passports & Confirmation of Permanent Residence [COPR].

Well now I think it might mean that they will continue to process the application received up until 31 December 2014 until 30 April 2015. So they may not accept and process applications received by them after 31 December 2014.

But nobody really seems to know so it is a guessing game and this game is not a fun one :)

I am June 23rd applicant. I read that some applicants from June 23rd have received their file back. I have not received my file so far so hopefully that won't happen in my case! I am lil bit concerned because my employment ref letter only mentions the brief job description.

Yesterday CIO charged apps received on June 13, June 14 & 15 fall on a weekend so has CIO started charging apps received on June 16th yet?

Can't remember when the form was changed - probably 1st July.

But it is immaterial as long as you don't have any child over 18.

I am very confident you don't have. So relax.
