Thanks Pipis Husband. I just got married tho in January and i saw on their website that it takes 17months to process spouse visa. I and my wife will remain in the US for sometime before relocating so thats why i didnt bother that much. I know i'll have to have more funds but what i want to clarify is if i must be in canada to file for her. After i get the visa, cant i do it from the US? Thanks

Sir, first thing to know that the time you saw on the website is only a guide. Just going by the exprience of people here who have been waiting for MR since 2014, not to talk of getting PPR should have been a lesson to you. Any time frame you see on CIC website is a wish and not always reality. Today you are seeing 17 months there, by April, it will change to 10 months then in June you will see 24 months there. Not even CIC can predict how things will work as FSW program has taught all of us so don't rely on timing seen on their website.

Secondly, that once you apply for spouse visa does not mean you will get it. As rightly pointed out by Guyman, you risk loosing your own PR visa for failing to update AVO with your marraige which clearly happened before you received PPR. You wil find it very difficult to convince the authorities that you hadn't any ulterior motive by not informing them before they issued your own visa. Don't forget that their every communication states, 'you must immediately inform us of any change to your status or family compostion.'

Third, you wont be able to sponsor your wife from US if you are not based in Canada yourself. Don't forget that you have a 'permanent resident' visa, key word being 'resident'. If you had Canadian citizenship, that would have been a different story as you can sponsor your father, mother, wife, children while living in any part of the world. But with your PR status, you will have to first prove that you have been a true PR and in 'good standing' too like I mentioned in my earlier post.

All the best.

@Donmakaveli first congrats on PPR....

To the matter of your spouse, I think you have two options; 1st) Go ahead and get your COPR, land then file for your wife as her sponsor...My cousin did this and He has run into some serious trouble....Please consider the following.....a). you cant sponsor your wife immediately, you need to get a job and work for a while ( I cant remember for how long you need to work before you can sponsor and show you can take care of her)..b.) secondly, when you eventually settle and you are ready to sponsor her, if the CIC finds out from the date of your marriage certificate that you were married at the time you got COPR and you did not disclose at the time (despite being told to do so in the PPR instruction (change in marital composition)), it will be seen as a case of misrepresentation and your PR status will be rescinded plus the normal ban penalty. Sadly my cousin who followed this strategy is going through this process at the moment although he has gotten a lawyer....If you want to do this, you might have to look for and provide a marriage certificate that is forward dated which will obviously suggest you got married after you got to canada, this should be fine. However, I will advise against this as I have learnt from my experiences in life to be as honest and straight forward as I can especially when it comes to something as serious as Canadian PR and Citizenship which is obviously important for my future and for my family.

The second option is basically what @Pipi"s husband has said, write a cover letter and let them know you got married in January ( I did the the same). Of course the process might take 2-3 extra months but it is certain that in the end, they will issue your self and your wife the visa and you will have peace of mind and be happy. After submitting the cover letter, try source funds to make up your POF for two people (they will most likely ask). Then wait, They will issue visa for you and your wife and you can move in with thanksgiving to God and peace of mind. In the end, the choice is firmly yours oo and I hope you make the best choice for yourself and your family. Cheers!
