FSW 2 - ARC

Hello All,

I am a FSW 2 Applicant *NOC 1236* my family and I filed a refugee claim in Canada back in 2008 our claim was rejected in 2011 eventhough we were found credible our application was denied to we failed to seek state protection in our country. We then filed an H C and PRRA application which was also denied in Nov.2011 we were asked to leave so we left, we got our departure certificates showing that we complied with everything. I worked since day 1 (close to 3 yrs) my company filed an AEO for me, my IETLS band is 7.5 and my self assestment points are 70.

Is there any one here applying for FSW2 who requires an ARC as well?? eventhough I have enough points and an AEO.. Im really concerned about ARC (Authorization to Return to Canada) Is there anybody here going through the same situation? Please share.

Hello Master : Well, I can tell you my story. I was a refugee claimant in 1995. I left Canada before decision made... I sent a letter when leaving that they never received. I have applied as FSW and they are now after medicals done requesting ARC for my family and I. I think that you should not have problems and as soon as you get yor FSW application approved just fill a form and pay $400 for you and any family member returning to Canada. Check out the CIC website inadmissibility section and you are going to start feeling better...

Thank you very much for sharing your experience! Like I said I complied with everything they asked since day 1.. My employer is very eager to have me back. Do you mind sharing more about your ARC experience though? I thought that ARC had to be filed at the same time than FSW? So has your ARC been approved for good? Thanks again!

Master7 : I have just found out that my application for refuge became a deportation order since I never showed up to the hearing and then they issued a removal order that ended up in deportation order. Without having a clue in 2007 I asked an immigration lawyer about my intentions of applying as a FSW and he told me that I could do it and I did it. Now after 5 years (normal for the famous 2007 FSW backlog) my lawyer asked me for proofs related to my departure in 1996 without receiving any removal or decision. I have already submitted my passports and a pile of other proofs that confirms my departure in 1996. My lawyer told me that my FSW application was approved (We had our medicals in June 2011) but now we need the ARC, because in this case the procedure is FSW approval and then deal with the ARC if you have not backgrounds problems (criminal,etc)... Yes, I thought you got a deportation order.. I'm glad you are aware now and most important you are acting on it! So you filed the whole FSW without ARC and you are filing ARC now? By the way did you have to submit your fingerprints to the RCMP?

Si Master7 ese es el procedimiento correcto segun lo leí en el website, aunque reconozco que lo inicié sin saber del ARC, pero siempre imaginé que algo de eso vendría... Primero se aplica y luego cuando ya estas en la etapa de chequeo de seguridad y antecedentes te solicitan el o los ARC, dependiendo de como fué tu partida y tu comportamiento durante tu estadía. Soy de Venezuela. Mis abogados me hablaron de 2 meses a partir del pago y envio de las formas del ARC, ojala y así sea porque creo que he visto casos que han tardado mucho mas en recibirlo, pero después de 5 años en esto se que cada caso es distinto...

Ah perdon en mi caso no me han solicitado huellas dactilares, no se si lo harán tampoco, espero que esto sea lo último que tenga que enviar (ARC) y otros detalles que estoy actualizando...

Master7 I have just met a girl that filed her ARC last October and she got her visa stamped last week. It was a case just like yours. She also told me that her application was not reviewed until she went again to the embassy to update her file on January after three months, she noticed that they start reviewing the application (ARC) in that moment and she got the visa last week. THERE IS BIG HOPE for us...

Thanks again for sharing, stories like this fill us with hope. Can you just tell me under what program is this girl applying under? FSW1? FSW2? Provincial Nominee? Marriage?

One more thing, according to what I've read in forums you are supposed to file your ARC until requested and not at the beginning of your application. What is your impression?
