Frustrating!!

So a little background. I applied for a visit visa for my Dad in 2022 to attend my cousin's wedding. And the application was rejected on the grounds that the purpose of staying is not consistent, no family ties in home country and lack of finances. (The duration of stay was for two weeks). Applied for a reconsideration (pointed out all the reasons for why the refusal was absolute bogus) application was approved. He traveled and to both the US and Canada that year.

This year he applied again for his nephews wedding and was rejected on the basis of the purpose of staying is not consistent, no family ties in home country.

Some context both the time the duration of visiting was two weeks and the first time he left back his wife and four kids and the second time it's just the four kids.

Now at the same time I also applied for my aunt. Who has no family in her home country l. And her application was approved.
I understand that the final decisions for all the applications are looked at by a visa officer. They should at least provide genuine refusal letter and not just dish out random generic refusals.

Before anyone comes at me that it's no one's right to get a visa I understand that. Just my rant on how the immigration system is massively failing here.

The reasons are not bogus. First time, your dad left back his wife in home country. Wife was a major tie, while adult children are not.

The first time the reasons were bogus. The same goes for the second time who said the children are adults?

I understand what you mean. They keep refusing mine they think I wont return to my home country. I provided EVERYTHING, job letter, bank statements, pay slips, living with parents. My sister is Canadian Citizen too. They must have me on a flagged list because they refused my application in just 2 days after I submitted it. The reason is all personal to them believing I wont return. How can that even be legal??

AI refused it this is not an uncommon refusal time period.

It's legal because the legislation gives them the authority and latitude to refuse applications for personal, financial, criminal, political and a host of other reasons. Don't like it, there is always the option for judicial review and failing that you can appeal to a higher court.

Not sure about your situation. But all the applications go through the AI system. What were your reasons for refusal?

I am 1000% convinced that it's all on a quota basis. And they don't really look at the merits of each application. Concerning my fathers situation. He has his work, property, investment and dependents he's leaving behind. Where as his sister who got the visa has none of the above besides work.

A lawyer doesn't really help other than if you want to do a judicial review. And even a successful judicial review doesn't guarantee you a visa. All it does is ensures your application is looked at by another officer.

Yes it is legal and they make it that way. Hence why the refusal letters are generic. Detailed, case-specific explanations would lead to legal challenges. By providing more generic reasons, IRCC aims to minimize potential legal complications.

So in the eyes of the IRCC you're perceived as an Immigrant
