Frustrated beyond belief but am I missing something?!

So story so far....
Hubby just finished 23 years in British Army and has been offered a job, same rank, job spec etc with Canadian Forces.
Positive LMIA received with supporting letter offering full time employment.
Scored 5.5 on the listening part of IELTS and re-sat this morning.
Left school with low grade GCSE's and joined the Army at 16.
Completed a Level 5 Diploma in Leadership and Management a few years ago which is currently being assessed by WES for ECA.

What if WES don't recognise it? What if he can't score the required level for IELTS?
If we went FST we'd be alright but the system will only let us go FSW??
Am I missing something???

First off, since your husband has an LMIA-supported job offer, CRS points are not the problem. Being eligible for one of the programs is.

FST is only for skilled trades. Your husband's job experience must be in specific NOC codes to qualify, or he must have a Canadian certificate of qualification for a skilled trade. Check here: http://www.cic.gc.ca/english/immigrate/trades/apply-who.asp

If this doesn't apply to him, then the only way is through FSW. This requires (among other things) at least a completed secondary education certified with an ECA, and meeting the minimum requirements for the language test. In addition, there is also a separate points system under which your husband needs to score 67 points out of 100: http://www.cic.gc.ca/english/immigrate/skilled/apply-factors.asp

If he doesn't meet any of the immigration programs' requirements, he can't apply.

One work-around could be to apply for a temporary work permit, work in Canada for 1 year and then qualify for CEC. But I'm not sure about requirements for temp work permits.

Thank you! I was really hoping there was another way, even though deep down I know there isn't

Unfortunately TWP isn't an option as the condition of the job is to have PR.

Fingers crossed he scores high enough this time on IELTS and WES manage to issue an ECA for his diploma

The principal applicant's spouse can also take the IELTS to add 5 more points to adaptability if your husband needs more points to reach the pass mark of 67 for FSW eligibility.

Have you taken the IELTS, Joanna?

Alternatively, the higher his IELTS scores are, the more points he can get for FSW eligibility.

You can make it up through IELTS hopefully if he loses points due to age and ECA.

It's all sooooo frustrating

They are desperate for him to start his job but we keep hitting these hurdles. We are all packed and ready to go, our furniture is in storage ready and we are living with my parents x

It does not make sanse. LMIA is done to hire foreign workers. If they really did that they can hire your husband with a work visa. If he had a PR, the LMIA would not be necessary.

My question not related to Immigration just asking because my family background is military. Actually you can leave one force and join other nation force? I mean yes you can do it but dont you think its too much complicated? LMIA for canadian force? Really?

go through this website and contact them directly if have any query, you dont have to apply under express entry in first place to come to canada.
i am sure they can guide you better than anyone on this forum, some time its hard to get hold of them but once get going with some of their official explain them your entire situation they will definitely guide you and help you with your application.

Sadly this is the criteria so we have to go with it

Thanks, I will try and contact them but as their criteria is identical, I fear it may be no good, but as the saying goes "if you don't ask, you don't get"
