Hello

The biggest problem that i have seen many people facing is that they are not able to get employment certificate from employer

in that case what documents can be submitted in lieu of these certificates

As a certified Canadian based Immigration cosultant/lawyer, please advise:

I have done my medicals and so far everything is gone smooth. They have even asked us to pay the RPRF. my child has Downs Syndrome. Have you personally come across any DS case accepted or rejected?

Not DS, but someone who was refused because of a child's autism contacted me for paid consultation.

The excessive demand provision of the medical requirements is heavily dependent on the personal circumstances.

they cannot refuse without addressing the specific medical state of the family member.

At least that is what was established through case-law in the federal court of Canada.

If you have done the medicals more than 3 months ago and they asked for the RPRF I would suspect they already recorded the medical codes and you are OK.

Dear Amir,

Thank you for your quick reply. We submitted the medicals and RPRF on 4th April,2010. For the record, the child has no Cardiac problem, no Thyroid, no hearing or vision problems. the DMP also did not click that she would require regular Specialist Check up. We had been asked to give about 3 months after we send our medicals and RPRF. My question is, can they decline just because she has DS; and if we choose to appeal thier descion after they send us a " Fairness Letter", are you legally qualified to represent us and if yes, then what is the process of appeal. I know personally 2 more parents who have similar issues. All three of us have done medicals, one of them asked to do repeat medicals, your reply will be highly appreciated.

Dear Mr. AMir.

I Have done my Medical & Sent RPR fee for me & My Spouse on 31st march 2010. But after sending 15 days i have received a letter that Procedure of Addition of New born Baby in to your application. Please Note that SHe is pregnant arround 4.5 moths till to date & Expected date of Delivery on Septem 10, 2010.

Will CHC Hold my Application till new baby born??? Or
Why did they sent such Letter
Is there any rules that baby should be born & then be added with Application???

I have sent a Letter to CHC mentioning Her Pregnancy report as well as medical test. WIll that affect anything???

I want to arrive there before my baby born. Is that possible in that Case???

Hi there,

It is hard to say about the specifics because I am not involved in your case.

You can appeal only after a refusal was issued, not after the "fairness letter". If you receive a fairness letter and you can make the case that the child will not cause excessive burden on health and social services they will need to deal with whatever evidence you present.

Usually people provide an expert advice or present the arrangements they have in their country of origin.

Thank you very much Amir for your answers and I am satisfied with it. Port of Spain Visa office have refused my FSW application due incorrect calculation of IELTS points. Here is my IELTS score

Listening- 6.5
Reading- 5.5
Writing- 6.5
Speaking- 7.0

Overall- 6.5

Visa officer has awarded me 10 points for this score. It should be 12 right? This is the reason I got 65 points in total. Shall I reapply or appeal? I got my IELTS result in Nov. 2009. Applied to CIC- 28Sep 2009, Full application sent to PoS -24 Dec. 2009, 2n AOR- 19th Jan. 2010. decision made - 15th april 2010 (date on letter), refusal letter received- 27 April 2010.

If i want to appeal, how? in how many days i can get reply from CHC? Will they reconsider my case and bring me on track?

Please help me out since you have large experience in handling such cases.

hi everyone


I came to Canada on a study permit on 26th July 2009 on a study permit. my program started on 30 Nov 2009. it is an 11-month full time certificate program of Network Administration and security. I have a masters degree in IT from india. I want to apply as a skilled worker. following is the infomation

Education : 25 points
Work experience : 15 points
Adaptability :5
English profeciency :16
age :10

Total is 71

I have a few questions

1) My work experience is of a Network administrator which is skill level B for 13 months from june 2008 to june 2009. but at the same time I was in my second year of my masters degree. but some how if i do some math i can pretty much have 15 hours credit (to be considered full time education) and 40-hours for work experience (which can be considered full time or equivalent part time). My employer is pretty co-operative with me and is happy to give me the letter. My question is my full time education or full time work at the same time could affect the case negatively in any way?

2) what are the details i should have in my work experience letter?
3)i have also worked on campus and have an awesome reference letter from them, should i include it in my application?
4) Do i need to stay in canada for the time my application is in process? or do i have implied status?
5) When can i apply - after july 2010 or after dec 2010? (because it be one year of legal residence in canada after july 2010 but my program started in nov 2009 )
