Fraud marriage Case

Hi,
I need suggestions and help to deal with my situation. I got married to someone who approached my family and said he wanted to marry me. When we started talking to each other, I had my PR application in process. It wasn’t complete. I found out that it would be quicker if I got married before getting PR and added him to my ongoing PR application which I did. He would ask for PR every time we talked and asked to come to Canada asap. Gave the reason I miss you, which I was fool to believe.

After coming to Canada, I applied for his open Work Permit as I wanted him to come here quicker but it got rejected as it was a inter religious marriage and was just registered under regular marriage but not special marriage act.
I got my PR call after one and half month and he did at the same time.
I did my flagpole and after that he came to Canada and got landing papers.
After a week he landed in Canada, he started abusing me mentally by commenting on my looks. Commented over my past jobs which I did in restaurant about cleaning the washrooms .Doubting my life over every small thing. He would call my parents at midnight to report single argument. It got worse day by day.
One day he decided to leave the house after an argument. He showed my middle finger before leaving the house. My parents always pressured me to compromise. Upon their forceful response after a week I went and apologized and he was back home.
After 3 days, he demanded my bank statements and my password for thr bank. After I refused that, he left the house without informing me and I found him after 4 hrs, he refused to come back.
Next day he came back to pick up his stuff and called the police saying that my wife is causing domestic violence. It was 8 at night and I was just shattered when he phoned 911 and accused me of causing domestic violence.
Cops came and found out nothing and said it’s just an argument, and asked him to leave the house. I told cops to never see his face again.
2 days later he came to my house again, I was sacred to see him standing near my place. I just drove from there. Then he called my friend and said I forgot few things to take.
Me and my friend went inside together, and he started threatening me to deport me to India and said that I will get your money (spousal maintenance) for 2 years. He said I will be the one living in Canada and you will be the one leaving. (Mind you , I have been living in the country for 5 years.I came as international student and got my PR through PNP)
Later he told another friend, he had been recording all our fights, arguments from the day one and collected all the evidences against me.
Questions:
1. What is the best thing to do legally in this case?
2. How can I prove his fraud?
3.Is it advisable to file divorce in Canada or India?

Sorry about your situation.

1. I would start by getting a restraining order from the police to keep him away from you. Then meet with a family lawyer to explore your legal options and find out how you can protect your assets.
2. This may be difficult unless you have hard evidence showing he committed fraud. You can try reporting him to IRCC but nothing may happen since you immigrated together. FYI there is no such thing as two year spousal support since you immigrated together.
3. You must be separated for a full year before you can apply for divorce.

wow that's really sad!

Please do not give him access to your finance and I agree with the previous comment put him away from you, get a restriction order and contact a lawyer who has more tools and knowledge on what to do. I know it is easy but do not fall in his game if he comes back with whatever excuse tell to live the house and tell him that you are recording him also. You can't allow this type of violence.
