Ok. NOW it makes more sense why CIC has all reasons to revoke your PR.

You see, you never (and your family) were following the regulations. You got your PR in 2004 only, when you definitely were older than 1 year, and I suppose after a struggle with CIC to reinstate your family PR status. After that- left again for a long time and lost your status, but in meantime you went back as PR when if fact you were not, and so on and so on. So, your family (and you as a part of it) has a long history of using the system and breaking the rules, so that is the real reason why they rejected your application for SP and will not reinstate your PR status.

But I suggest to speak to an immigration lawyer (as a last resort) if you are ready to invest a lot of money into that battle or try another country as Australia or UK.

Alright first thing, Canadian govt approched US to collect the PR card, before the 2000s there was no PR Card so all the travelling was done on your landing document, now as far as breaking the rule is considered, I dont see an instance where we broke the rule, I have spent a significant amount in time in canada from 2004 to 2008. In 2009, the canadian govt. sent us the application forms for renewal of our PR cards, but my father didnt submit the application for renewal as I told you before, he had no intentions of returning. I dont see where "rules are broken". The immigration officer rejected my application for TD on grounds of not meeting residency obligation for the previous 5 years.

If your father (the principle applicant) was so fortunate to receive application forms for renewal and didn't do so, then you as his son cannot re-instate PR independently after the rule was broken. Regina is right, your family might have paid less attention to or manipulated the system's rules. Get immigration lawyer to help with your SP.

I can't pinpoint! If you've not broken the rule, the visa officer wouldn't have rejected your re-instatement of PR. They work according to the rules. If you think you're right, then get immigration lawyer as Regina suggested. It would be better. You may also apply for study permit while your PR appeal application is till under consideration, but you need to satisfy the visa officer that you meet all the requirement for study visa.

I do not see them granting you a temp resident visa, right after they rejected your application to keep your PR. The VO will come to the conclusion that you are using the student route as a means to immigrate to Canada.

Alright so here is what happened:

1. I applied for student visa on the 2nd of June, without any SOP.
2. I got a call for medical on the 26th of June.
3. My visa was issued on the 7th of July.

Interestingly enough, the avg visa processing in Pakistan nowadays is 11 weeks, I got my visa in 5 weeks and now this is how I look like... ;D
