Hi again... one more question.

Can we use this form "IMM 5409" as 'affidavits attesting to the fact that we're leaving together' ? as the immigrant checklist ask for? on other post somone suggest it but it seems quite confusing because I should use it just if i have a co-signer as we agreed above?

So if then, what kind of form can we use to this 'affidavits attesting to the fact that you have been living together
and representing yourself to your community as living in a conjugal
relationship for at least one year' (Appendix A from the country specific section)

Thanks in advance...
hi boaz yes rjessome suggested u this form she is a very very senior member and she knows what's she talking abt...in fact for the past 2 years some embassies (Buffalo maybe others) do ask for this form later in the process of common-law category....this usually delays the process a little so it's better to send a file as complete as possilble....for those who submitted the form it's no harm don't worry, they will understand why u submitted it....if they want they will use it if not they won't....
this form is like a marriage certificate but for common-law people....if it's easy for u to have it then include it, if it's not (for example u don't want to officially say to a gouv body there that u live in common-law) then don't....if u include it include it in the place with id documents to show ir civil status or with the common-law proofs....they will know it's not related to having a co-signer

hope this clarifies everybody's confusion!! good luck!! :)

I had a short vacation (from my computer as well) and it's great to come back and see this detaild answer. THANKS!

I'm thinking about diffrent options now (insted of spobsorship) mainly because me & my partner are running off time. we want to move to Canada in few months time and i see no way that she'll get the PR before that and want her to be able to work legally as soon as we move. what we think to do sounds completly absurd but might be the best way for us. it is to ask for student permit for me on my Israli passport (though i'm a Canadian citizen) and then she can get an open work permit immediately...

I really appreciate all your answers above and it seems like pepole here does have great knowledge to share.. so I'll be happy to read what do you think about such an idea...? i did post it on a diffrent post as well named "Is it better not to be a Canadian citizen?"

One more question... if we'll decide to go for the sponsorship option, can my common law partner enter canada while the application is in process and get it by sending her passport to the visa office in Tel aviv without actully going back to israel (consider our application will be approved and no intrview needed).

many thanks in advance...

p.s - i did ask those question on a diffrent post so i'm sorry for the duality.

If you are a Canadian citizen, I'm doubting that CIC will issue you any kind of visa. It might also be considered misrepresentation, because you would be applying for a Canadian visa on your other passport, even though you already know you are a Canadian citizen.

Proceed with caution.

Hi,

I'm in the process of completing an application to sponsor my boyfriend as a common-law partner. We've been together for 4 and a half years and have been living together in the UK for 3 years. We're hoping to move to Canada as soon as the application can be processed. I've just joined this forum - it seems like a great resource :)

One of the questions that's arisen for us is the issue of providing "statutory declarations from individuals with personal knowledge of our relationship". I've read through your answers above, OhCanadiana, and thanks for the useful info! I was wondering if you would mind my piggy-backing on this thread and clarifying a few things for me?
- Can these letters be from our parents (ie. one from my parents and one from my partner's parents), or is it better to have them written by people who aren't in our families?
- Do the declarations definitely need to be signed by a commissioner for oaths / lawyer? I assume from the use of the words 'statutory' that they do - but I just thought I'd check if something more informal like a signed letter might suffice.

Any thoughts or advice would be greatly appreciated!

Thanks,
Jess

I don't see why not. I think what matters most is to make sure they are from people who can speak to the genuineness of your relationship. Don't overthink it ;) If you start driving yourself nuts, add an extra one.

They should be signed by someone who can take sworn statements and who will check the ID of the signer (to ensure they aren't just letters you made up in some complex fraudulent scheme...). I'd use the list of who can certify copies as a starting point:

"Who can certify copies?

Persons authorized to certify copies include the following:

In Canada:

a commissioner of oaths
a notary public
a justice of the peace

Outside Canada:

a judge
a magistrate
a notary public
an officer of a court of justice
a commissioner authorized to administer oaths in the country in which the person is living

Family members may not certify copies of your documents."

Take a look at this thread where I gave someone else some advice on a common-law application yesterday.

Welcome again, and feel free to keep asking :)
