Foriegn student- finished study before time-Need help

Hi group members,

I am a wife of a foreign student in Canada. I have a open work permit.

My husband's study permit and my work permit- both will expire in April 2016. But my husband is going to finish his study in September 2015 which is before the expiry date of my work permit and his study permit. I have a question whether can I work using the same work permit after my husband finishes his study (Sep 2015) since it is valid till Apr 2016? Or do I have to apply for a new work permit? If I have to apply for a new work permit, can I continue working using my old WP untill my application is accepted?

A response would be greatly appreciated as I have a job right now and I don't want to lose it.

Hi Rina,

I'll do my best to answer your question:

There are a few factors to consider,namely, the new study permit rules enacted in June of 2014.

These rules basically state that a foreign student must remain enrolled in school until completion of studies and if they finish early they must leave Canada within 90 days of receiving their diploma/certificate etc.

However, the 90 day rule (mentioned above) only applies to students who received a study permit after June 1st 2014. So, if you're husband received his study permit before June 2014 than you and he should be fine until the expiry of your original permits.

But, if he applies for a PGWP than you may be forced to give up your OWP.
