Forgot to update marital status before getting landing paper

I forgot to update my marital status before receiving my landing paper and now my landing paper says single. If I apply for my spouse PR under family immigration will there be problems? How much do amendments take?

You should contact your VO immediately. They will let you know what you have to do to add your spouse to the application, whether it's accompanying or not. Most importantly, you do not land in Canada until you get a new Confirmation of Permanent Residency. If you land with the document you have right now, you will never be able to sponsor your spouse in the future.

It's likely to add at least a couple of months and maybe more. Your spouse will need a medical and to pass all admissibility checks before you will receive an updated COPR. If your spouse is accompanying you, a second COPR will be given to them.

I am already done with my landing and I realized this when I was ready to file for my wife. What is a solution? File express entry instead? Amendment to the landing paper can take months

OP said in his latest post that he has already landed. There is nothing the VO can do.

Landing papers cannot be amended after landing to include a spouse.

Your question has already been answered in your other thread in detail.

You can never sponsor your spouse.

Your options are to either give up your PR status and apply again from scratch. Or to have your spouse apply to immigrate on their own through express entry or another economic immigration stream.

Basically, you are screwed. You have committed major misrepresentation (landing as single when you were in fact married), and as a result you can never sponsor your wife, ever.

You only have 2 options to proceed here if you want to live with your wife in Canada.
1. Renounce your PR status, move back to home country, and re-apply for PR again from scratch this time including your wife in app
2. If your wife qualifies for an economic immigration stream, she can apply for PR separately

I wish that you had said that you were already a "landed" PR. As the others have said, you are now stuck. IRPR 117(9)(d) applies.

(9) A foreign national shall not be considered a member of the family class by virtue of their relationship to a sponsor if
  • (d) subject to subsection (10), the sponsor previously made an application for permanent residence and became a permanent resident and, at the time of that application, the foreign national was a non-accompanying family member of the sponsor and was not examined.

Whoever the attorneys are you need to fire them right the way. It doesn't matter your were married before or after you filed your PR, as long as you landed as a "single", and in fact you were married, you had committed immigration fraud. And because your wife didn't list on your PR application and didn't go through the examination, she is forever excluded as your family member. Please go check IRCC 177 9 (d).

I can even imaging from here that the attorneys will ask you to go on with H&C route, when your sponsorship will be rightfully rejected. But unless you have sufficient proofs to prove the extreme hardship that if the appeal would dismissed, the H&C approval chance for you is next to zero. Also, most likely, CIC will launch an investigation to against your own PR status on the ground of misrepresentation, and your PR status will probably be revoked and you will be banned for 5 years.

Anyway, I believe the attorneys are pretty much positive on the money in your pocket, not your case.

That detail is irrelevant. It doesn't matter when you applied for PR or when you submitted your passport. You married BEFORE LANDING AS A PR and therefore were required to add your spouse to you app. You committed misrepresentation and cannot sponsor your spouse.

Fire these "attorneys".

Your attorneys are complete idiots and gave you completely wrong advice. The only important date is your marital status the day you landed as a PR.

There are literally hundreds of such cases on this forum you can search, or on canlii. All end in same rejection when the PR attempts to sponsor the spouse not included in their original app. A number of them also go on to revoke PR status of the original PR sponsor.

As everyone else has said - fire your attorneys. They have no idea what they are doing.

Hope you haven't given them any money. If you have, you should request a full refund.
