@ ailooney... Hi sis!! Ang validity ng implied status is not 90 days but until you receive the CPC Vegreville decision's on your WP application. If approved and WP, walang problem sa status. If not, and the decision arrives after 90 days from WP expiry, need to exit Canada kasi di ka makakapagparestore.
Restoration of status applies if di u nakapagapply ng extension prior to existing WP expiry or new WP. You can apply for restoration WITHIN 90 days from work permit expiry on November 2.
For WP extension, you will use same form IMM1249, tick the box “C”, be it WP for new employer or extension of existing WP. Item No. 10 also has option for “Change Conditions”, dun ilalagay mga explanations sa “My request”....
Two (2) types of case below:
1) Sabi mo inapply daw ng existing employer ng LMO si hubby, try to ask from the employer courier receipt for the LMO application to Service Canada, tell them na kelngan nyo iattach sa application for WP extension para maging implied status kayo, and tuloy tuloy kayo makapagwork.
Kasi mas safe kung magaaply ka ng extension for WP sa existing employer at least implied status kayo while waiting dun sa LMO ng new employer. Afterall, di naman alam ng existing employer na may prospective employer kayo na kumukuha ng LMO. At least pag dumating ang LMO sa new employer, apply na kayo ng WP for new employer, mas mabilis na ngayon pag paper application compared to online, it's 66 days as of October 5, 2011.
2) But if your hubby's existing employer can't provide him with proof of LMO application, I suggest wag muna natin iconsider na nagapply nga ng LMO. Sa case nyo ng hubby mo na November 2 ang expiry, you said na last week nagapply na ng LMO ang new employer, get a copy of the LMO application receipt and file for “Application to Change Condition, Extend My Stay or Remain or Change Conditions in Canada” (use IMM 1249) and attach an explanation that LMO has been filed, etc... You also said that's LMO processing would take about 8 weeks, so if 1st week of October nasend ang LMO application, you expect it to arrive ng mga mid December. Since 66 days lang ang processing ng NEW work permit, pag inapply mo sya this early, lalabas din un supposedly ng mga mid December, kaso pag nauna yun WP decision sa LMO, madedeny kasi di mo nasubmit un positive LMO. So pag mga October 22-25 mo siguro sinubmit yun WP application for new employer, mga 1st week of January 2012 mo na matatanggap decision, and prior to that, based sa timeline mo is nainform mo na Call Centre sa LMO file number kasi dadating ang LMO ng december, right? Kaya magiging positive ang outcome ng WP application... Ang magiging problem is pag bumilis pa ng bumilis ang new WP paper application kasi baka maunahan ang LMO.. Cguro try mo online application for new employer parang 78 days..I suggest check u din lagi un processing times sa link na nasend...
Your dilemma would be: kung d nagfile ng lmo existing employer, di makapagextend ng work ang hubby mo dun. It is illegal to work without valid WP, pati part time. Ksi ang legal work ng hubby mo would be para sa new employer. Pero yun sayo, di me sure if you can still continue to work, lalo't dependent ang stay at permit mo sa husband's. Pero kung may kakilala kayo siguro, baka pwede pero without legal documents like tax, t4 declaration etc? Not certain about this.
Kaya lang me nakarelate kasi ako nagaasikaso papers ng brother-in-law ko, and hanggat wala syang work, kami muna ni hubby ang sagot sa expenses ng family nya dto sa phils... Kung may ibang cases na related to this, pakipost nalang para mainform din kami kung may other options..
