Hi everyone... :)

I'm a Canadian citizen, and my fianceé is Indonesian. We are getting married (in Indonesia) sometime in October 2012. It's likely that a few weeks after the wedding, I am going back to Canada since I have to get back to work. She will stay in Indonesia, and we hope to submit our sponsorship application sometime in December 2012. We plan to do it outland (through Singapore).

My questions are:

1. Once my future wife's Canadian permanent resident visa is issued (who knows when...!!), she will have how many months before her visa expires? In other words, when she gets her PR, she can stay in Indonesia for a maximum of how many months before the PR expires?

2. Let's say my future wife gets pregnant sometime in summer 2013, and let's say when our baby is born, my future wife's visa application is still being processed.

a. Will we have to send a new visa application for the baby (soon after he/she was born), to the CIC? And pay the fees for the baby's application?

b. If my future wife gets pregnant in summer 2013, she will most likely give birth in spring of 2014. That kind of worries me, because then doesn't it mean that the baby's PR will be issued a lot, lot later......? And by the time the baby's PR is issued, then my future wife's PR (if it's been issued) could've expired too, and that's not good at all.

3. I live in Ontario. By default, new residents of Ontario are eligible for OHIP coverage just 3 months after landing. It would be nice if my future wife could give birth in Canada, with an OHIP coverage. If she gets pregnant in summer 2013 and we let the CIC know about it, do you think they'd be so kind to expedite the visa application process, so that she gets her PR sooner, and can land in Canada at the very latest during the 6th month of her pregnancy (earlier is even better), to ensure that by the time she gives birth, she will already be eligible for OHIP coverage?

Thanks!

1. She will have the time upto the expire of her medicals or the expiry of her passport, whichever is sooner.

2. Your baby would be a canadian citizen

3. I can't answer this, as each visa office works differently, they may or they may not.

1. Wait a minute......something doesn't add up here. According to the CIC:

canadainternational.gc.ca/singapore-singapour/visas/medical-medicaux.aspx?view=d

"If you are applying under the family class and being sponsored as a spouse, common-law partner, conjugal partner, or dependent child, then you should complete your medical examination before submitting your application. "

So for spousal sponsorship, the medical examination has to be done before submitting the application. Surely, by the time her PR is issued (which could take a year or more), her medicals will have expired a long time ago? How can we possibly use it as a base of her visa's expiry date?

2. Surely the baby won't automatically become Canadian, right? I bet I'll have to submit proof of my Canadian citizenship, along with some forms to fill up. How many months does it take, to process the baby's Canadian citizenship?

1. Yes, your wife will more than likely need to redo her medical, though there is a new exemption that may or may not apply. It's ridiculous, but this is how it goes when dealing with governments...

2. Your child will be considered a Canadian citizen from birth, but yes, you will need to apply for (official) proof of citizenship. Yes, there are some forms to fill and you need to submit proof of your citizenship (I submitted my passport nd health card). You will also need to get your marriage license translated by a certified translator (no need to notarize). It took us about 3 months.

So the sponsored spouse of a spousal sponsorship has to do the medical twice?! That's really odd....never heard of that before, as it's not even stated on the CIC website.

Do all (sponsored) foreign spouses have to do it twice?

How come neither the CIC site nor the available PDF forms mention about that?

The medical only is good for one year so by default, if your sponsorship takes longer than this time frame they will more than likely ask you to re-do it.

Ahh I see! Now it makes a lot more sense (although, they should clearly state this on the CIC site).

Worst case scenario: what if she gets her PR 2 weeks before her first medical expires? (In other words, 11.5 months after her first medical). Mathematically speaking, she'll only have 12 - 11.5 = 0.5 month = 2 weeks to enter Canada, or else her PR expires? That's crazy...!

Yes that's correct she'd have to land within the 2 weeks. I'm not sure if you had a reason why you couldn't land within the 2 weeks if CIC could somehow extend that by you having to go through another medical or not. There was one person on the boards a while back that got the call Friday that if he came to pick up his passport that day he'd have to be landed by the Monday. It can happen!

OP: From what I have read, CIC usually gives you more time to land than 2 weeks. That's one of the reasons why they request an additional medical. If you have to do a second medical (or they waive it and get it done internally via the new rules), then you have more time to land. Personally, I don't mind paying for a second medical if it gives us more time to land. The last thing I want is to rush everything. Yes, I could fly to Canada with my wife and complete the landing procedure and then return to China, but that would be expensive (airfare + hotel).

Since you are going through Singapore, you will probably be eligible for the new rule regarding medicals.

Good luck and I wish you a speedy process!
