I've recently read some posts on the forum that people have successfully flagpoled at the border while out of status, however this was from a few years back.
I've read that they are trying to crack down on people flagpoling I was wondering if had recently had any luck with flagpoling while out of status?
I've been getting a variety of different answers to this query and can't contact CIC via phone or they don't answer my questions via email.

Currently waiting on an LMIA (which is taking longer than estimated by consultant that employer is using) and have all other documents ready to go. My previous application for work permit was denied because the pending LMIA didn't arrive in time before the application was processed. Hence I'm out of status and have 90 days to restore my status however if I get the LMIA before my status is restored would it be worthwhile going to flagpole?

The official rules are that you must be in status in Canada to flagpole to obtain a work permit. So if you call CIC - that's what they'll tell you. Those who were able to obtain work permits at the border while out of status happened to hit a CBSA official who broke that rules. So it's really the luck of the draw. If you hit a CBSA officer who goes by the rules, you might find yourself with a departure order. So it's risky. Safest option is to restore your status.
