hi All

please I need clear answer on this case; I have sponsored my wife while I am abroad. she got the visa as immigrant now and we have to go for Canada for landing. I need to know what steps we should do while we are there, should we apply for PRC or she will get it automatically once we landed in Canada, what other things we shall do ,please clarify in detail.

Hey Firas,

congrats on getting the PR! the next steps are easy. Book a flight to Canada for your wife, before the expiry date (it's written on the visa).
She needs to have her visa, her COPR (confirmation of PR), and a B4 form filled out if she's planning on importing anything to Canada, either now, or later.
When she arrives at immigration, she can let the officer know that she wants to land as a PR ( but it's pretty obvious from her visa), and most likely she will be sent to a side office. There, they will ask her identity, and have her signed the paper. Also if possible she should travel with a copy of marriage certificate, although I've never seen anybody being asked for it. The officer will also ask for her address in Canada. If you don't have a fixed address yet, she can give a friend's address. The PR card will be sent there after 2 to 3 months, no need to do anything. Once the papers are signed, that's it, she is a PR of Canada. it's a very easy process.

After that, she can apply for healthcare, depending on the province the process is different. You can go to any "Service "province"" office (Service BC, Service Ontario etc.), and ask about it. She can also go to Service Canada with her passport and signed COPR ( there is 2 copies, the officer will give her one), to get a SIN to be able to work.

then you can just settle in the country!
Good luck,
Sweden

thanks for your answer,

I have one more question. my wife will go to make the landing next month. I knew that she will left her information on the airport so they will send her the PRC within a couple of months or more. I am Canadian citizen and right now living outside Canada, so my wife will need only to make the landing (with me) then we have to leave within 10 days by max.

Can we leave within that time so we will get our PRC on our mail box to one of our friend? will they question us on the airport about the PRC? is it mandatory to stay till we receive the PRC? please I need practical answers :)

Regards,
Firas

You can use a friend or family address in Canada to send the PR card to.

If your wife has a visa-exempt passport, she should be able to return to Canada as a visitor without the actual PR card, and just use the COPR to confirm her status at Canada immigration.

However if she is not visa-exempt, in order to return to Canada you will need to either find a way to get the PR card sent to you, or she'll need to get a special travel document from a local Canadian visa office wherever you guys are living.

I don't know what's visa exempt, I have applied to her a spouse sponsorship ,and they provided her an immigrant visa. we can get the PR through a friend while we are away. but knowing that she can't wait 3 months to get the PR, will they question her when she left Canada about the PR card or she can leave by using her original passport ?

thanks,
Firas

You only need a PR card for entering Canada... not for leaving.

If a friend can deliver the PR card to you, then you should have no problems returning to Canada.

The PR card would take 6 to 8 weeks to arrive. Your wife may leave Canada without the card but will need the card to enter Canada. In absence of the card, she can apply for documents from the Embassy of the country she will stay. Also, your friend here can mail your wife the card (just be sure).

Within the 10 days period, your wife may go apply for Health Card with the proof of landing paper and her passport, but in the province of Ontario, you may not get health benefit before 90 days have passed since landing anyway. So, she can do that when she comes back.

Because it looks like you are not planning on residing in Canada she can't apply for medical. You will not have medical either.

After the PP request , when they give the PP back to you with the spousal PR visa.

Is the spousal PR visa stamped or stickered inside the PP or something.

Do they also give you a landing paper or something with it ?

When I came to Canada on my own a few years back as a Landed immigrant , nothing was put inside my Indian PP.

I got the landing paper ( Record of landing ) and my Indian PP..which I used to land as an immigrant.

Is it the same for sponsored spousal PR visa ? They give your spouse the PP back and the landing paper , or do they actually stamp or sticker the spousal PR visa inside the PP ?

PR i.e Permanent Resident.

Hello Firas,

I'd like to point out the following text from CIC operational manual ENF 4 "Port of Entry Examinations", in section 12 "Examining foreign nationals seeking to become permanent residents at ports of entry."

12.5 "The examining BSO [border services officer] should:

[...]

confirm that the applicant intends to establish permanent residence in Canada."

http://www.cic.gc.ca/english/resources/manuals/enf/enf04-eng.pdf

The first five pages of Chapter 9 of the guide to sponsorship appeals by the IAD has further information on what is meant by "intends to establish permanent residence in Canada."

http://www.irb-cisr.gc.ca/eng/brdcom/references/legjur/documents/SpoPar09_e.pdf

So if you don't intend to live in Canada immediately after landing, and the officer finds out about this, it appears you could have a problem.
