Filling inside or outside Canada

Hello all, My wife and I married just over 2 months ago, and I have but a few days until my visitors visa runs out in Canada. I have all my documents in order, all my bacckground checks and medicals done. I am ready to send my extension and application to Vegreville.

I have been working with an immigration lawyer who has advised me to apply inland. However, i have been reading alot online and through the cic.gc.ca website that suggests applying outside of canada (in my case the UK) would be much quicker.

My main concern about applying outside is;

Will Canadian Immigration ask me to leave once my visitors visa expired even though my extension has been submitted.

You are allowed to stay in the country when an application is being processed outside Canada, but I think you need to send your extension application about a month before your old visa expires.

Why, exactly, does your lawyer want you to apply inland? Applying through the UK will, in the vast majority of cases, be faster then applying inland.

Thankyou for your promt reply. Basically the lawyer said if i apply outland, the canadian immigration might ask me to leave the country. To be honest that is not an option for me, as my wife is bipolar, and i dont think she could handle us being apart for 12 months or whatever. I have been over here for a year now on 2 visitors visa, my money is slowly drying up, and i dont want this process to take another 18 months. If applying outland is faster then this seems like the better optioon for me. But can you tell me any pros and cons!

If you apply outside Canada you could be forced to leave if your visiting visa is not renewed. However, if you have some time left on your present visa this might not be an issue since London should be faster processing PR applications than Vegreville is processing visa extensions. While the extension is being processed you're allowed to stay under implied status, if memory serves.

The previous advisor seems to have given you a mixbag to choose from without thinking about what if you were required to attend an interview in the UK? Will you go back to UK for that interview? If you do then you have to leave Canada which will cause you to relinguish your temporary status and may not be able to return to Canada until your permanent residency was confirmed.
