Filing Tax Return Question

Hi everyone,

My husband is Canadian who lives in Alberta, and I am permanent resident who works overseas. We are not living together yet and my income is more than his annually.

So far, the tax topic is unclear to me and he does not want to explain it to me. So, he asked me to send him my sin number and date of birth to file a tax return. When I ask him why since we dont live together yet and that he is not supporting me financially yet coz he has debts..etc.

he's like he must put my sin and dob to say he is married, and that he'll advise them that he is supporting me financially!! and that I am unemployed and overseas for a family matter!!!

Now, I need to understand how this works and its impact on me because dont wanna end up having a messy situation when I moved to live with him, especially that I do have a bank account there as well and do send money in it every now and then.

The problem when I ask for clarification he got pissed and started to yell at me, and he's like if I say you are working then I dont get paid!

You are working overseas. And he wants to claim you as dependant while you don't even live in Canada and lied that you have no income?

How long have you been married? What is your status in Canada?

Because he's my husband, he is putting me his dependent. He's telling me not to worry of these things till I come and to just provide him these details to file the tax return.

I became a permanent resident a few months ago, and the plan is to move there to my husband in a few months. For now, Im working overseas while he's also working and closing his debts.

I just want to understand if this could impact me in anyway when I move, especially this tax thing is not very clear to me and dont wanna miss my history.

He can put you as dependant but he need to put down your estimated income (even it's foreign income). And if your income is high, he may not get any extra money by listing you as his dependent.

You may or may not need to file tax for this year because you just came a PR and may not spent enough time for this tax year to file it.

Does this mean that it is not a must he puts my sin number and date of birth in his tax return?

Now, he just told me that he went to do the tax return and had to pay money instead of getting any :s , because he needed to verify he is married through these details.

I believe that I deserve to understand. I cant do things blindly.

He does need your SIN number and the rough income amount to add you as his spouse.

I believe he does know your DOB :p

I am not very good at explaining how tax return works because I use a software to do my own.

But I do fill in those information about my husband in my own tax return. Since both of us work, we do not ended up claiming each other as "dependent". But we do need each others information in our tax forms.

Your husband is trying to commit tax fraud by claiming tax credits/benefits that he isn't eligible for.

Yes, this could most certainly cause you problems in the future if he declares your income incorrectly.

In general you can't simply claim the spouse/dependent amount for a tax credit, if the spouse is not living in Canada with you.

In order to claim this amount for a spouse not living in Canada, you need to prove to the CRA that you are in fact supporting them. So your husband would need to show proofs like regular money wire transfers to you, proof that you are dependent on him financially, etc etc. As mentioned CRA would also ask for your world income earned outside Canada and if it's anything significant (like over $10K), that would also make the claim ineligible.

Thank you so much for your response, and I'll go through the source to see if I should pay any tax.

However, I would like to ask you if he does claim I am unemployed, and since I am overseas so I did not agree on this or sign any thing. How would this affect me?

He got upset saying because I did not give him the sin, so he cant prove he is married so they ask him to pay money instead of getting any. At the end, I just sent him.

I dont like to do things blindly without understanding how the system works. The last thing i want to do is to ruin my future!

He is claiming that you have no income so he will qualify for a return versus paying taxes. You really need to speak to your husband since if he is trying to commit tax fraud not sure what else he may be doing.
